On June Z7, 2014, the Division of Water Resources (Division) received an application, dated June
24, 2014, requesting a 401 Water Quality Certification and Buffer Authorization from the Division
for the subject project. The Division has determined that the application is incomplete and cannot
be processed at this time. Om July 7,8 and 9,2O14,DVVR sent eDlai|stn you requesting this
information as well. The application is on-hold until the following items are addressed-
1. Apervkous access trail boaDexisting dock upto4 feet in width (measured along the
shoreline) that does not result in tree removal lsan exempt use. |f the proposed access
consists ofimpervious surface, iS greater than 4 feet in width or results \n the removal of
trees then it is an allowable use that requires a determination of "no practical
alternatives." Please provide justification for constructing the access trail of impervious
materials such as pavers o/crushed stone as proposed in your application and discussed in
ernai|s or revise the plan to minimize the impact to the riparian buffer.
2. If the stairway is proposed to be wider than 4 feet then please explain why the additional
width is necessary or revise the plan to minimize the impact to the riparian buffer.
3. Please provide anupdated drawing tD represent any changes to your plan and include any
updated impact amounts Js discussed inthe emnail6.

This letter only addresses the initial administrative review and does not authorize any impacts
to wetlands, waters or protected buffers. Pursuant toTitle I54 NCAC 03H .0502/e\, the applicant
shall furnish all of the above requested information for the proper consideration of the
application. If all of the requested information is not received in writing within 30 calendar days of
your receipt of this letter, the Division will be unable to process the application and it will be
returned. The return of this project will necessitate reapplication to the Division for approval,
including a complete application package and the appropriate fee, Please be aware that there is
no authorization under the Section 401 of the Clean Water Act for this activity and any work done
within waters of the state may bea violation ofNorth Carolina General Statutes and
Administrative Code.
