Klimek, P.E. Director Division of Water Quality DWQ Project # 05-0949 Johnston County On June 1, 2005, the Division of Water Quality (DWQ) received your application dated May 19, 2005, to impact 1.9 acres of wetlands to construct the proposed retail or commercial development. On June 17, 2005, the DWQ received correct payment of $475.00 to process your application. On July 14, 2005, DWQ sent you a letter requesting more information to process your application. On August 8, 2005, the DWQ received your revised application in which you requested that your project be considered for permitting under an Individual Permit, rather than the NW 18, NW27 and NW39 permits under which the project had previously submitted. The DWQ has again determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impact Justification (Avoidance and Minimization) DWQ cannot authorize fill of wetlands through a 401 Water Quality Certification or through an Isolated Wetlands Permit without a detailed design plan to show the layout of the proposed commercial development. Without the design plan DWQ cannot quantitatively or qualitatively determine if proper avoidance and minimization of impacts has occurred in the planning of the project. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands,, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
