Seong and Griffin Sr, This is a provisional verification for Nationwide Permits 39 (PNK Holdings, LLC) and 14 (350 South Landholdings, LLC). Your proposed work may be authorized by the above referenced Nationwide Permits provided a 401 Water Quality Certification (WQC) is issued or waived. Once a 401 WQC is issued or waived, the Corps will provide you with final Nationwide Permit verifications. Your proposed work shall not commence until after the 401 WQC has been issued or waived AND until final Nationwide Permit verifications have been provided to you. Additional special conditions may be added to the final Nationwide Permit verifications, including the following: 1) In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Forms (3). The requirements of these forms, including any special conditions listed on these forms, are hereby incorporated as special conditions of this permit. (see attached Draft forms) 2) No permanent discharges of dredged or fill material are authorized in Stream DSA. Impacts to this feature are to avoided for the Gallimore Dairy Road extension project component via installation of the bottomless culvert as shown of the plan sheet labeled Sheet No. EX2.0, "Open -Bottom Culvert Impact Exhibit" of the enclosed plans. 3) No permanent discharges of dredged or fill material are authorized in Stream MSA. Impacts to this feature are to avoided for the 12-inch sanitary sewer project component via installation of an aerial sewer crossing as shown of the plan sheet labeled Sheet No. EX3.0, "Aerial Stream Crossing Buffer Impact Exhbit" of the enclosed plans. 4) Groundwater base flow to Stream MSB down -drainage of the authorized impact limits for the PNK-High Point project component must be maintained per the French drain detail as shown on the plan sheet labeled "PNK- High Point" "French Drain" of the enclosed plans. 5) Stream and wetland impacts authorized herein are considered part of the High Point North Industrial Center single and complete project. Please note that future impacts and/or phases of the PNK-High Point and Gallimore Dairy Road extension project components, as well as future impacts and/or phases of the High Point North Industrial Center and related activities associated with Corps Action ID: SAW-2014-02098, may be considered part of a single and complete project. These impacts may be considered cumulative with impacts authorized during earlier phases with respect to compensatory mitigation and Nationwide Permit thresholds. Current cumulative impacts to waters of the US for the High Point North Industrial Center single and complete project i include a total loss of 0.0197 acre (158 linear feet) of streams and 0.027 acre of wetlands, or a total of 0.0467 acre of waters of the US.
