Good afternoon IRT,
I hope everyone is doing well. I wanted to go ahead and send out this report and see if any IRT
members are interested in a site visit. I just found out last week that I'll be shifting into the
Washington Field Office chief position starting in August so my ability to get out in the field before
then is unlikely. If anyone is wanting to get out and look at the site, I will gladly set that up with RES;
it just won't be in the cards before I start my detail.
As you will recall, the Bucher as -built was broken into 2 separate phases (Section A and B) due to
saturated weather conditions back in early 2021. The IRT conducted a site visit for Section A on
September 8, 2021, followed by the enclosed credit release. This as -built report is for Section B.
The below referenced FINAL As -Built Monitoring Report review has been requested by EBX-Neuse I,
LLC. Per Section 332.8(o)(9) of the 2008 Mitigation Rule, this review follows the streamlined review
process, which requires an IRT review period of 15 calendar days from this email notification. Please
provide any comments by 5 PM on the 15-day comment deadline shown below. When providing
comments please indicate if your concerns are great enough that you intend to request an
ADDITIONAL site visit prior to the as -built release. Comments provided after the 15-day comment
deadline (shown below) may not be considered.
At the conclusion of this comment period, a copy of all comments will be provided to EBX-Neuse I,
LLC and the NCIRT along with District Engineer's intent to approve or disapprove this Final As -Built
and as -built implementation credit release.

Dear Mr. Breslow:
This correspondence is in reference to the Neu -Con UMBI, Bucher Mitigation Project,
located at 3132 Redwood Road, in Durham, Durham County, North Carolina. The
mitigation site is adjacent to and within the Neuse River Basin, Hydrologic Unit Code
(HUC) 03020201. The purpose of this letter is to confirm the as -built release of credits for
this site associated with Section A of the project.
As a result of complications encountered during construction of the pond portion of
the project, you requested to separate the as -built in to two separate sections (A & B),
which was agreed to by the IRT. As a result, this as -built credit release for Section A is a
partial release of as -built credits based on the portion of the project located downstream
of the pond on the site. Additional, during an IRT field review of the as -built conducted on
September 8, 2021, we agreed to minor changes to the mitigation approach and ratio
associated with Reach CH6. This change resulted in a minor adjustment to the credit
total for the site. As a result, the new credit total for the site has been changed to
11,491.14 credits, and the credit amount associated with this release and future
scheduled releases reflects this change. Please note that due to decision to split the as-
bult release into two phases, it was determined that the construction bond for the site
must remain in effect until the second as -built credit release.
Pursuant to the UMBI entitled, Agreement to Establish the Neu -Con Umbrella Wetland
Mitigation and Stream Restoration Bank, approved April 2, 2001 and amended April 10,
2009; and the site -specific Bucher Mitigation Project Final Mitigation Plan, dated
September 2019, 15 percent of the mitigation site's total restoration and enhancement
credits shall be available for sale immediately upon completion of implementation of the
Mitigation Plan and submittal of the Baseline Monitoring Report and As -built Survey,
which includes construction of all stream restoration and enhancement activities as
described in the Plan and associated with Section A, and successful completion of all
planting activities as described in the Plan, dated September 2019. All preservation
credits associated with the project were previously released as part of the initial credit
release. By copy of this correspondence, we confirm that you have satisfied the above
requirements for the initial credit release, and 1,136.425 stream mitigation units (SMUs)
are now available for sale.
