On July 13, 2022, Mike Lawyer with the Fayetteville Regional Office reached out to the consultant to determine whether the facility was compliant with coverage under a Stormwater No -Exposure Certification. It was determined that this facility will not be operational for several months. Our No -Exposure application instructs permittees to apply no more than 90 days before start of operation. Based on guidance from the Regional and Central Offices, you are instructed to reapply closer to the opening date of the facility. With this letter, your application is being returned to you. Please be advised that if the State determines that discharges from this site contribute to a water quality standard violation or are a significant contributor of pollutants to waters of the U.S., the Department of Environmental Quality (DEQ) is authorized to require a discharge permit. The return of this application does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local government permit or approval that may be required. Our program anticipates to receive a new and updated application for coverage under a no -exposure certification closer to start of operations for your facility.
