The purpose of this letter is to request a modification to permit SAW-2006-20100 that is held by
NASH Wendell Falls, LLC. The permit, issued to Mercury Development and transferred to Nash
Wendell Falls, LLC on May 7, 2014, authorized impacts to 0.16 acres of open water, 2,354 linear
feet of perennial stream, 581 linear feet of intermittent stream and 3.24 acres of wetlands.
Temporary impacts were authorized to 0.2 acres of wetlands for mechanized land clearing, and
an additional 2.39 acres of wetlands and 625 linear feet for utility line installation associated with
the construction of the Wendell Falls Development. The project is located on the west side of
Martin Pond Road (SR 2503), in Wendell, Wake County, North Carolina. The site is
approximately 1300 acres and is found at Latitude 35.7694621'N and Longitude 78.4220719'W.
The project contains unnamed tributaries to Marks Creek within the Neuse River Basin (HUC
03020201).
In light of the December 31, 2022 permit expiration, the current modification request is
necessary to reflect changes in the land plan, adjust sewer impacts to comply with current design
standards and utilization needs, develop Americans with Disabilities Act (ADA)-accessible
greenway trails, to construct roadways to access high ground not formerly utilized, and to extend
the existing permit authorization. The modifications are necessary to account for planning,
engineering, and market force oversights, and to refine assumptions that were made during the
initial permit application process. The applicant hereby requests authorization for the changes
described herein and requests that the permit expiration date be extended to December 31, 2027.
A prior permit modification was approved on June 6, 2014 that eliminated two road crossings to
re -habilitate a failing dam, which is currently used as a source of irrigation for 15 acres on the
site. The June 6, 2014 modifications authorized impacts to 135 linear feet of stream channel
below the dam embankment for the construction of a plunge pool, and authorized temporary
construction activities. The modification also included permanent impacts associated with
flooding of 45 linear feet of intermittent stream. Rather than providing monetary compensation
for the unavoidable impacts to jurisdictional features proposed under the June 6, 2014 permit
modification request, the applicant abandoned a proposal to construct two road crossings (R1 and
R7) which proposed 135 linear feet of permanent stream impacts and 0.11 acres of permanent
wetland impacts, respectively.
Under the approved permit authorization, the project contemplated 4000 residential units and
450,000 square feet of retail and commercial uses. The current site plan maintains the number of
residential units and more than doubles the proposed square footage of retail and commercial
uses through vertical construction. The currently proposed permit modifications described in the
attached tables and figures can be summarized as follows: total temporary impacts associated
with sewer installation decrease by 58 linear feet of streams and 0.022 acres of wetlands; ADA
greenways and a new pedestrian trail increase permanent stream impacts by 89.4 linear feet and
wetland impacts by 0.002 acres; roadway stream impacts decreased by 63 linear feet.
The current site plan shows the distribution of residential and commercial uses throughout the
development. The current site plan maintains the commercial uses proximate to the intersection
of Wendell Falls Blvd and Interstate 87. While the footprint of the commercial area has
increased, the majority of the increases in the available square footage are associated with
vertical development that will achieve five stories. The revised land development plan includes
a comprehensive stormwater management plan that is administered by the developer in
accordance with Wake County standards that achieve Phase II treatment standards. All
stormwater basins discharge at the highest possible elevation within the drainage basins, and
incorporate energy dissipation.
This permit modification proposes the minimum necessary impacts to complete the construction
of the sewer infrastructure sized for the build -out of the project. Temporary sewer installation
impacts are necessary to connect the site with City of Raleigh Public Utility Department
(CORPUD) facilities. With the exception of sewer impacts 18 and 21, all of the proposed sewer
infrastructure is designed and constructed to serve the entirety of the resident drainage basin to
its current zoned capacity. The overall length of stream impacts from sewers decreases by 58
linear feet through the use of aerial crossings at two separate locations, one of which requires the
minimum necessary wetland impacts for the construction of support piers. The aerial crossing
drawings specify that the lines will be encased and shows that they are over 4' above the existing
channel. All areas that are temporarily impacted will be restored to pre-existing contours and
stabilized in accordance with erosion control best management practices per CORPUD
requirements.
Permanent stream impacts associated with greenway and pedestrian trails have increased 89.4
linear feet due to planning oversights during the initial permitting of the project. Specifically,
the design of a section of ADA-accessible greenway did not account for topographic constraints
that exceed ADA slope design standards. Impacts associated with G9 are necessary to create
pedestrian connectivity throughout the site and utilize an existing pedestrian underpass of
Wetlands & Waters, Inc.

Wendell Falls Parkway. The initial planning concepts placed the pedestrian underpass at its
location but failed to account for slopes that rise into the development area. As a result, it is
necessary to construct a long sloping switchback that complies with ADA requirements.
Fortunately, the best alternative aligns with a 30 foot wide CORPUD utility ROW and does not
require the removal of any trees or result in conditions that substantially differ from the current
use. The impacts have been minimized as much as possible by designing a bulb out that
minimizes the impacts while providing mandated slopes.
The project includes additional buffer impacts at the proposed Neuse River Veterinary Hospital
totaling 286 sqft. for stormwater outlet protection. The protection is necessary due to CORPUD
restrictions that prohibit outlet discharges in their ROW. No other stabilization alternatives have
been identified by the project engineer.
The attached table enumerates the changes from the previously permitted length to the total
impacts necessary to complete the project. The attached drawings depict each of the crossings in
plan and profile. Project impacts for stream crossings remain essentially the same considering
the reallocation of impacts amongst the permitted crossings.
The project has already mitigated for the approved 2,354 linear feet of streams, 2.51 acres of
wetland impacts and 405,031 square feet of buffer impacts based on a NC Ecosystem
Enhancement Program receipt dated November 14, 2007. The applicant is proposing additional
mitigation for the proposed additional 8 linear feet of impacts through either the state in -lieu fee
program or a private mitigation bank at a 2:1 ratio (in accordance with the Mitigation Banking
Rules and current applicable fees) 90 days prior to the construction of the crossing R16. The
applicant proposes no additional mitigation for the additional 0.001 acres (398 sqft.) of wetland
impacts that result from the project as the increases are associated with temporary sewer
construction.
Under the proposed permit modification, impacts to stream buffers increase by a total of 2,219
square feet. Permanent buffer impacts associated with road and greenway construction under this
modification total 7,380 sqft. and temporary impacts associated with utility installation total
4704 sqft.
Buffer mitigation for new impacts is assessed at 4,179 sqft. based on 283 sqft. of zone one
impacts at a 3:1 ratio and 2,220 sqft. of zone two impacts at a 1.5:1 ratio. The total buffer
mitigation requirement would be paid within 60 days of authorization of this modification.
There are no known occurrences of federally protected species within the project area based on
the attached Natural Heritage Program report. We do not believe it is necessary to conduct
surveys for federally protected terrestrial plant or animal species to make a "no effect"
determination since no new terrestrial species have been added to the list of Federally Protected
Species within Wake County, NC since the initial permit was issued. A number of protected
aquatic species have been listed as occurring in Wake County since the initial permit was issued;
however, we do not believe it necessary to conduct surveys for aquatic species because there are
no known occurrences of these species within Marks Creek, a tributary of the Neuse River,
which has been the subject of many biological studies by both private and public entities

including the Triangle Land Conservancy and the NC Ecosystem Enhancement Program. None
of the studies identified populations of the recently listed species in Marks Creek.
We believe that there is no need to conduct additional Cultural Resources reviews for the site
since the boundaries of the project have not changed and no previously unidentified cultural
resources have been discovered during construction of the project.
