Purpose of the project is to provide up to 46 single family residential lots in Johnston County, NC The access the rear of the property, a single road crossing is proposed that would incur
wetland and stream impacts. The wetland and stream system crossing the entire site and there is no way to avoid the necessary crossing to reach usable land.

The necessary road crossing will incur 16,946 square feet of impact to the wetland and 519 square feet of impart to the stream. No indirect impacts are anticipated as this is a single and
complete project. Typical equipment will be used such as graders, excavators, dump trucks, bulldozers, etc.

Terracon biologists performed a habitat assessment to identify potential habitat for the federal species listed for Johnston County. The stream that is
crossed is a small 1st order stream that flows through a forested wetland and is braided in some areas with discontinuous channel segments throughout.
The stream is too small for the Carolina madtom and Neuse River waterdog and does not provide the necessary habitat for the two mussel species
listed. The project should have No Effect on any listed species. NCNHP data from May 2022 does not document any occurrences within at least one
mile of the site and no critical habitats are identified.

1. Topographical and Boundary data obtained from Johnston County GIS.
2. The contractor shall notify and cooperate with all utility companies or firms having facilities
on or adjacent to the site before disturbing, altering, removing, relocating, adjusting or
connecting to said facilities.
3. All excavation is unclassified and shall include all materials encountered.
4. All structural fill material shall be free of all sticks, rocks, and clumps of mud.
5. Unusable excavated materials and all waste resulting from clearing and grubbing shall be
disposed of off -site by the contractor in an approved solid waste landfill.
6. Location of underground utilities are approximate and must be field verified. Contact the
NC One Call Center at least 48 hours prior to digging @ 1.800.632.4949. Lambert
Surveying has only located the utilities that are above ground at the time
of field survey. Underground lines shown hereon are approximate or as reported by
various responsible parties. The surveyor does not guarantee that any underground
structures such as utilities, tanks and pipes are located hereon.
7. All pipe lengths are horizontal distances and are approximate.
8. All work shall comply with all applicable codes, regulations, and/or local standards imposed
by local utility.
9. All construction and materials shall meet NCDOT Standards, latest edition. All work within
NCDOT right-of-way shall meet the specifications and standards of NCDOT.
10. All concrete pipe is to be ASTM C-76, Class III with ram-nek.
11. This property is not located in a Flood Hazard Zone per FEMA Map.
12. All lot dimensions shown are approximate. Consult the boundary survey for actual site
boundary information.
13. The contractor shall be responsible for all work zone traffic control in or adjacent to NCDOT
right-of-way. All signs, pavement markings and other traffic control devices shall conform
to the Manual on Uniform Traffic Control Devices (MUTCD), 2003 edition as amended.
14. Prior to placing CABC stone base, the contractor should notify the Engineer to
inspect and proof roll the subgrade. Any stone placed without prior approval will be the sole
responsibility of the contractor.
15. DESIGN/FIELD CONDITIONS quite easily may vary from that represented in the initial
soils report and/or topographical report. Isolated areas may show up weak and adverse
soils or groundwater conditions may be discovered that were not revealed during the initial
soils investigation. Therefore, the Contractor is to be aware that Stocks Engineering, P.A.
will not and cannot be held responsible for any failures to street pavement design as a result
of soil conditions.
16. All utility services, (power, telephone, cable, etc.) are proposed to be underground. Do not
seed or mulch disturbed areas until all underground utilities have been installed. Utility
Contractors to bring Main Services to R/W as shown in plans.
17. Regulatory signs, stops signs and street name signs shall be manufactured from high
intensity reflective materials and shall be supplied by the contractor.

elevation of all existing utilities by digging test pits by hand at all utility crossings well in

construction.
26. The contractor is responsible for the design and implementation of all required/necessary
sheeting, shoring, and special excavation measures required on the project to meet OSHA,
Federal, State and Local regulations pursuant to the installation of the work indicated on
the drawings. The Owner and Stocks Engineering, P.A. accept no responsibility for the design
to install said items.
27. The contractor shall include in the contract price daily record keeping of the as -built
condition of all of the underground utilities, construction stakeout associated with the
project. Preparation of the necessary/required as -built plans to be submitted to the
Engineer and all other information required in connection with release of bonds.
28. The Land Disturbance Permit must be kept on the work site and shown upon request.
29. The contractor shall include in the contract price any de -watering necessary to construct
the project as shown on the plans.
30. The contractor shall include in the price, any and all costs associated with providing a
professional engineer on site if required, during the construction of the storm water
management facilities, underground utilities, etc. as required for as -built certification.
31. All grass, topsoil and 'building debris material' dumped onsite shall be removed in the
base bid prior to placement of structural fill material.
32. All generated waste shall be disposed of on -site as directed by the owner.
33. Do not apply permanent seed and mulch until underground electric has been installed.
34. All right-of-ways are to be public.
35. Evaluation of 404 Jurisdictional Wetlands. No filling of grading is to be performed in
areas designated as 404 jurisdictional wetland until an approved permit has been
obtained from the USCOE and NCDEM DWQ.
36. The site is to be served by septic sewer and public water.
37. Soils on the property have been evaluated by Dan Bliley. Actual soil survey
data is provided not county soil mapping data. Soil Report has been submitted.
38. Contractor is responsible for coordinating installation of underground utilities and shall
regrade and reseed any areas disturbed during installation.
39. Fire Hydrant locations are shown representative. All Fire Hydrants shall be located
1' inside the right-of-way and shall not be located in a ditch or Swale.
40. Blow -offs in shoulder shall have a concrete collar.
41. A turn lane on Powhatan Road wiil be required per NCDOT.

Location description: The Powhatan Farm property is located on the south side of Powhatan Road, approximately 2,000 feet
east of its intersection with Glen Laurel Road in the Town of Clavton, NC. It is bounded by Powhatan Road on the north, and

® There appear to be waters on the above described project area/property, that may be subject to Section 404 of the Clean
Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The waters
have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. The
approximate boundaries of these waters are shown on the enclosed delineation map dated July 2021. Therefore this
preliminary jurisdiction determination may be used in the permit evaluation process, including determining
compensatory mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other
resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands
that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This
preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process
(Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable action, by contacting the
Corps district for further instruction.
❑ There appear to be waters on the above described project area/property, that may be subject to Section 404 of the Clean Water
Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). However, since the waters
have not been properly delineated, this preliminary jurisdiction determination may not be used in the permit evaluation process.
Without a verified wetland delineation, this preliminary determination is merely an effective presumption of CWA/RHA
jurisdiction over all of the waters at the project area, which is not sufficiently accurate and reliable to support an enforceable
permit decision. We recommend that you have the waters on your project area/property delineated. As the Corps may not be able
to accomplish this wetland delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can
be verified by the Corps.
B. Approved Determination
❑ There are Navigable Waters of the United States within the above described project area/property subject to the permit
requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water Act
(CWA)(33 USC § 1344). Unless there is a change in law or our published regulations, this determination may be relied upon for
a period not to exceed five years from the date of this notification.

❑ The property is located in one of the 20 Coastal Counties subject to regulation under the Coastal Area Management Act (CAMA).

Placement of dredged or fill material within waters of the US, including wetlands, without a Department of the Army permit may
constitute a violation of Section 301 of the Clean Water Act (33 USC § 1311). Placement of dredged or fill material, construction or
placement of structures, or work within navigable waters of the United States without a Department of the Army permit may
constitute a violation of Sections 9 and/or 10 of the Rivers and Harbors Act (33 USC § 401 and/or 403). If you have any questions

SECTION I - The following identifies your rights and options regarding an administrative appeal of the above decision.

A: INITIAL PROFFERED PERMIT: You may accept or object to the permit.
• ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your
signature on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all
rights to appeal the permit, including its terms and conditions, and approved jurisdictional determinations associated with the
permit.
• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request
that the permit be modified accordingly. You must complete Section II of this form and return the form to the district
engineer. Your objections must be received by the district engineer within 60 days of the date of this notice, or you will
forfeit your right to appeal the permit in the future. Upon receipt of your letter, the district engineer will evaluate your
objections and may: (a) modify the permit to address all of your concerns, (b) modify the permit to address some of your
