Box 368 Thomasville, North Carolina 27361-0368 Dear Permittee: 7/12/2022 Subject: NOTICE OF VIOLATION NOV-2022-PC-0366 Failure to Submit Sampling Plan NPDES Permit No. NC0024112 Hamby Creek WWTP, 6.0 MGD Davidson County, WSRO The City of Thomasville has violated Special Condition A. (10.) of the NPDES Permit NC0024112 (effective on April 1, 2022), which required the City to submit a Sampling Plan to demonstrate representative sampling in the vicinity of the receiving stream Outfall 001 (Discharge Point) by June 30, 2022. The requirement was made to assess the effluent characteristics (fecal coliform, dissolved oxygen, and pH) at the effluent's WWTP and Discharge Point and determine whether the sampling location is representative. The information submitted on June 21, 2022, did not include the required Sampling Plan and was a reiteration of the permittee's comments on the draft NPDES permit. The NPDES permit was issued without appeal and remains in effect. The permittee must provide a sampling plan which complies with the issued NPDES permit conditions. Please be aware that non-compliance with your permit could result in enforcement action by the Division of Water Resources for these and any additional violations of State law. Pursuant to G.S. 143 215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143 215.1. To prevent further action, please respond in writing to this office within ten (10) business days upon your receipt of this Notice of Violation. A review of your response will be considered, along with any additional information provided. If no response is received in this office in the 10-day period, a civil penalty assessment may be prepared. We appreciate your attention to this matter.
