We have obtained the Nationwide permit 12 and submjtted appropriate PCN Form previously (See attachments Eric Alsmeyer is in the process of issuing the updated Nationwide, Permit 12 ) We chose to bore, under creek to minimize the impact as much as,possible in this environmental sensitive area, and that we wouldn't have to,obtain a 401 permit We believe we`have gone through all the appropriate channels and obtained all necessary permits The project has been long approved since,and is currently under construction. The contractor (Larry Rhinehart of Carolina Bldg Contractor) is getting ready to bore the sewer main connection per approved plans. See attached sheet C -0 for the overall plan and sheet C -7 for the sewer /water plans It,came to my attention in early May from the Larry contractor that NCDENR (Ms Jennifer Burdette office) may require additional permit:(401) for this sewer crossing. My understanding from speaking toJennifer is that because the sewer encasing, is +/ -,4" above the existing creek bed, therefore it's considered an impact. I personally do not believe it is an impact. We did the best we could with the existing sewer on the other side of the creek is too shallow. The encasing size is what City of Raleigh requires. Raleigh requires us to make the (very expensive) sewer main extension We could have lived with septic fields for the development. If this 4" sewer encasing above the creek bed is considered an impact, and a separate 401 permit is required, then we would like to go for the open cut, since it is the same permit. It,would save us substantial construction cost for not having to bore I spoke with Keith Tew who approved the sewer /water plans previously, and he confirmed that open cut is allowed per City of Raleigh Eric and Jennifer, thank you both fortspeaking with me in the last few weeks regarding this matter We would like to move forward with the construction method revision for the open cut, and will submit-the 401 permit application to Jennifer office as soon as I hear back from you Please advise Thank you Hy V. It's a proposed 8" public gravity sewer, tying into Raleigh existing 15" sewer trunk, to serve the 8000 sf new building of Van Hanh Temple project. We have to cross the creek once; top of bank to top of bank is approximately 20' -35'. It's the Powell Creek, a tributary of Harris Creek., I am looking to bore under it, with perhaps 1' below the bottom of creek. FYI.
