I saw the new changes regarding a pre -filing be done again before a PCN submittal. I am planning on submitting the PCN
in the near future and since there is no current pre -filing application form, I am providing a summary of the project
below. I know DWR is still trying to figure things out, but for now I hope this information will suffice as a Pre -Filing
Request.
This project is Laurel Ridge Phase 2B located at 406 Blufftonwood Drive in Pittsboro, Chatham County, NC. The project is
approximately 70 acres and is a proposed single-family residential development. The project applicant is Laurel Ridge
Development Inc (Attn: Hadley Kirkland). The overall project consists of the construction of a single-family residential
development including but not limited to roadway infrastructure, residential lots, utilities, and SCMs. Specifically, there
are three (3) road crossings that impact streams. Existing conditions onsite consists primarily of undisturbed forested
land. There is an existing 50' utility easement located near the northwestern portion of the property. Blufftonwood
Drive bisects the parcels north to south. General land use in the vicinity of the project consists of forested land with a
few rural single-family homes. Dry Creek is located south of the project. Rock Rest Road bounds the property to the
north and Old Graham Road bounds the property to the west. Please see the attached site plan and note that this may
change as we are working with the engineers to minimize impacts.

Explanation:
The site visit was completed on December 11, 2019 by Drew Blake with the Chatham County Watershed
Protection Department and Steven Ball of Soil & Environmental Consultants (S&EC), on Parcel # 86169
that is located within the Jordan Lake watershed. The Laurel Ridge Bluffs Subdivision was originally
proposed prior to 2008 and is not currently subject to the 2012 Subdivision Regulations that are enforced by
the Chatham County Planning Department. As such, the property is only subject to the 1994 Chatham
County Watershed Protection Ordinance and the Jordan Lake Buffer Rules, at this time. The 1994 Chatham
County Watershed Protection Ordinance places a 50-ft buffer on all streams mapped on the USGS
topographic map and a 100-ft buffer on all "rivers" and along all perennial and intermittent streams within
2,500-ft thereof. The Jordan Lake Buffer Rules place a 50-ft buffer on all intermittent and perennial streams
that are shown on either the USGS topographic or NRCS Soil Survey maps. The USGS topographic map
depicts two (2) mapped streams and the NRCS depicts three (3) streams.
S&EC personnel completed a previous site visit which resulted in the identification of two (2) intermittent
streams and one (1) perennial stream on the property. All features identified by S&EC were reviewed by
Andy Williams of the USACE on September 24, 2019. The USACE claimed jurisdiction over the features as
depicted on the attached Wetland Sketch Map completed by S&EC after confirming the presence of an
Ordinary High Water Mark. S&EC submitted a request for Chatham County to complete a formal review to
determine if the features would be subject to riparian buffers. All points of origin and stream type transitions
were reviewed in the field by all parties in attendance. One (1) intermittent stream segment was downgraded
to an ephemeral stream and doesn't require a buffer at this time.
Required Riparian Buffers:
Stream Feature A (Dry Creek) was confirmed as a perennial stream and will receive a 50-ft buffer on both
sides from the top of bank in accordance with the Jordan Lake Buffer Rules. Stream Feature B was
confirmed as an intermittent stream and will receive a 50-ft buffer on both sides from the top of bank in
accordance with the Jordan Lake Buffer Rules. Stream Feature C was downgraded from an intermittent
stream to an ephemeral stream and will not receive a buffer at this time.
Any future modifications to the property boundaries (i.e. Subdivision) will require additional reviews
from the Chatham County Watershed Protection Department. These reviews may result in the

identification of additional features that require buffers or an increase in the buffer width of features
found during this review.
Proposed Buffer Impacts:
Submittal of a No Practical Alternatives Authorization Application, in accordance with Section 304 (I) of the
Chatham County Watershed Protection Ordinance, must occur if this project results in impacts to riparian
buffers. No Practical Alternatives Authorization Applications must be submitted prior to or at the same time
as the projects Soil Erosion and Sedimentation Control Plans. All approvals for the No Practical Alternatives
Authorization must be received prior to submitting the for Construction Plan approval from the Chatham
County Planning Department.
Conclusion:
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by Chatham County, on parcels outside of the Jordan Lake
watershed, may submit a request for appeal in writing to the Watershed Review Board. A request for a
determination by the Watershed Review Board shall be made in accordance with Section 304 of the Chatham
County Watershed Protection Ordinance. Landowners or affected parties that dispute a determination made
by Chatham County, on parcels inside the Jordan Lake watershed, shall submit a request for appeal in writing
to NC DWR, 401 & Buffer Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27669-1650 attention of
the Director of the NC Division of Water Quality.
In cases when disconnected stream features and/or isolated wetlands were identified, the areas upstream and
downstream were assessed for hydrologic connectivity to other identified features. Staff determines in the
field if such a connection exists and to what the extent. Connections to other nearby features and subsequent
buffers are applied accordingly.
Should this project result in any direct impacts to surface water features (i.e., crossing and/or filling streams
or wetlands) additional reviews may be necessary. Additionally, a Section 404/401 Permit may be required.

PUMP —AROUND PRACTICE
DESCRIPTION:
The work should consist of installing a temporary pump around
and supporting measures to divert flow around in —stream construction sites.
IMPLEMENTATION SEQUENCE:
Sediment control measures, pump —around practices, and associated channel and bank
construction should be completed in the following sequence (refer to Detail 2/SE1):
1 Construction should not begin until all sediment and erosion control measures
have been installed and approved by the engineer and the sediment control inspector.
The contractor should stay within the limits of the disturbance as shown on the plan
and minimize disturbance within the work area whenever possible.
2 Upon installation of all sediment control measures and approval by the sediment
control inspector, the contractor should begin work at the upstream
section and proceed downstream beginning with the establishment of stabilized construction
entrances. In some cases, work may begin downstream if appropriate. The sequence of
construction must be followed unless the contractor gets written approval for deviations
from the engineer or local authority. Work should not be conducted in the channel during
rain events.
3 Sandbag dikes should be situated at the upstream and downstream ends of the work
area as shown on the plans, and stream flow should be pumped around the work area.
The pump should discharge onto a stable velocity dissipater made of riprap.
4 Excavated topsoil and subsoil should be kept separate, placed on the upland side of
the excavation, and replaced in their natural order.
5 All construction should take place during stream low flows. The length of construction
time should be limited to a maximum of 2 days for each crossing.
6 Water from the work area should be pumped to a dewatering bag as shown in detail 3.25.
The measure should be located
such that the water drains back into the channel below the downstream sandbag dike.
7 Traversing a channel reach with equipment within the work area where no work is proposed
should be avoided. If equipment has to traverse such a reach for access to another area,
then timber mats or similar measures should be used to minimize disturbance to the channel.
Temporary stream crossings should be used only when necessary and only where noted on the
plans or specified.
8 All stream restoration measures should be installed as indicated by the plans and all
banks graded in accordance with the grading plans and typical cross —sections. All grading
must be stabilized at the end of each day with seed and mulch or seed and matting as
specified on the plans.
9 After an area is completed and stabilized, the clean water dike should be removed.
After the first sediment flush, a new clean water dike should be established upstream
from the old sediment dike. Finally, upon establishment of a new sediment dike below
the old one, the old sediment dike should be removed.
10 The contractor is responsible for providing access to and maintaining all erosion
and sediment control devices until the sediment control inspector approves their removal.

We have reviewed the referenced project using the USFWS North Carolina Field Office's online project
review process and have followed all guidance and instructions in completing the review. We completed
our review February 22, 2022 and are submitting our project review package in accordance with the
instructions for further review.
Our proposed action consists of: A planned residential development that is proposing a stream crossing.
The location of the project and the action area are identified on the enclosed maps.
Laurel Ridge Phase 2B (35.809706, -78.209213). The site is located at 406 Blufftonwood Dr, Pittsboro —
Chatham County, North Carolina.
Construction will commence following the anticipated Section 404 & 401 Approvals and should be
completed by the Nationwide Permit Expiration date of March 15, 2026.
This project review is needed under provisions of Section 7 of the Endangered Species Act (ESA), and
per General Condition 18 of Nationwide Permit 29.
The enclosed project review package provides the information about the species and critical habitat
considered in our review. The species conclusions table included in the package identifies our
determinations for the resources that may be affected by the project.

Dear Mr. Kirkland:
On February 3, 2022, Soil & Environmental Consultants, PA (S&EC) evaluated the Laurel Ridge
Phase 2B property shown on the attached maps for potential endangered species. The property is located
at 406 Blufftonwood Drive in Chatham County, NC. Surface waters on -site flow into Dry Creek in the
Cape Fear River Basin, which has been classified in the "Classification and NC DWQ Standards
Applicable to Surface Waters and Wetlands of North Carolina" as WS-IV; NSW.
We obtained the attached automatically generated official species list from the U.S. Fish & Wildlife
Service (FWS) and N.C. Natural Heritage Program (NHP) report identifying the protected species on or
within one mile of the project area that could potentially be affected by the project. These FWS & NHP
reports were updated as of the date of this report. The official species list is valid for 90 days.
We conducted site assessments to identify potential suitable habitat and preliminary surveys for the
individual species listed on the official species list. This included assessing the physical characteristics of
the streams, identifying forest types, and looking for evidence of the listed species on -site. This survey
did not include any detailed sampling or netting. The results of the search are discussed below.

RESULTS:
The FWS official species list identified the following species for the Evaluation limits:
• Red -cockaded Woodpecker (Picoides borealis), Endangered
• Cape Fear Shiner (Notropis mekistocholas), Endangered
• Harperella (Ptilimnium nodosum), Endagered
Of the species identified on the official species list, the NHP report did identify a Federally endangered
species within one mile of the project area. The NHP report listed an elemental occurrence for Cape
Fear Shiner from 2007. Other State listed species were found within the project area as listed in the
attached NHP report. The NHP report identified three natural areas and two managed areas within the
project area or within one mile of the project area. These are listed out in the attached NHP Report.
RED -COCKADED WOODPECKER (Picoides borealis):
S&EC personnel conducted preliminary surveys of suitable habitat (foraging and cavity trees) and
individual Red -cockaded Woodpeckers (RCWs) within the project area. We found no individual
RCWs within the project area. The NHP report did not list any known elemental occurrence within the
project area or within one mile of the site. We found no ideal suitable habitat (e.g., Long Leaf pine
forests) within the project area. The Loblolly pine stands on -site are too young (± 20 years old) to be
considered suitable habitat. Given the lack of species present, and no presence of suitable habitat we
concluded that the project would have "No effect" on RCWs.
CAPE FEAR SHINER (Notropis mekistocholas)
During the preliminary survey for the Cape Fear Shiner, we looked for any suitable habitat and
evidence of the species being present. The NHP report did list a known elemental occurrence within
one mile of the site from 2007. These species are found in the Upper Cape Fear River Basin. The
suitable habitat these species are found in are streams with rocky substrate with slow flowing water.
While we did not specifically sample for the species, we also did not find any evidence of the species
while conducting our preliminary surveys of the streams for potential suitable habitat.
Our preliminary survey concluded that potential suitable habitat does not exist on -site. Dry Creek was
+/-10 feet wide with strong baseflow and had a rocky sandy substrate. Additionally, the other streams

on -site did not have suitable habitat. There are no proposed impacts to Dry Creek. Due to these
observations, we have concluded that the project would have "No effect" on the Cape Fear Shiner.
HARPERELLA (Ptilimnium nodosum):
S&EC personnel conducted preliminary surveys of suitable habitat within the project areas. It should
be noted this survey took place outside of the optimal survey window (July through early September).
We found no individual Harperella species within the project area. The NHP report did not list any
known elemental occurrence within the project area or one mile of the project area. We found suitable
habitat within the project area since Dry Creek on -site did have cobble sandy shoals. There are no
proposed impacts to Dry Creek, so we have concluded that the project would have "No effect" on
Harperella. We recommend consulting with the USFWS and/or conducting follow up surveys within
the optimal survey window.
BALD EAGLE (Haliaeetus leucocephalus):
S&EC personnel conducted preliminary surveys of suitable habitat, nesting sites, and individual Bald
Eagles within the project area. During our survey, we found no evidence of Bald Eagles or any nesting
sites within the project area. The NHP report did not identify any known nests on -site or within one
mile of the site. Given the lack of species present, we have concluded that the project is "Unlikely to
disturb nesting bald eagles". We believe no Eagle Act Permit is required.
NORTHERN LONG-EARED BAT (Myotis septentrionalis):
S&EC personnel conducted preliminary surveys for suitable habitat and individual Northern Long-
eared Bats (NLEB's) within the project area. During our survey, we found no individual species.
Relying upon the findings of the 1/5/2016 Programmatic Biological Opinion for Final 4(d) Rule on the
Northern Long -Eared Bat and Activities Excepted from Take Prohibitions to fulfill our project -specific
section 7 responsibilities." Due to the nature of the project being residential development, we
concluded that the project would "May affect, but not likely to adversely affect" NLEB's.
CONCLUSION:
After completing the habitat assessments and preliminary surveys, S&EC completed the attached
"Species Conclusion Table" and "Self -Certification Letter". Using language typically used by the FWS

in their conclusion letters, we have concluded that it appears the proposed project is not likely to
adversely affect any federally listed endangered or threatened species, their formally designated
critical habitat, or species currently proposed for listing under the Endangered Species Act (ESA).
However, as suitable habitat exists for Harperella the USFWS should be consulted to determine if
surveys need to occur during the optimal survey windows for Harperella to ensure that no plants exist
within the disturbed limits of the project. We strongly recommend requesting a concurrence letter from
the FWS.

To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

web site often for updated information or changes
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

towers (e.g., cellular, digital television, radio, and emergency broadcast) can be found at: http://

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/

S&EC completed a wetland delineation and buffer evaluation for the entire property so that natural resources could be identified, and impact minimized
to the maximum extent practicable. Impact 1 is proposed permanent, permanent -no permanent, and temporary stream impacts for a driveway crossing.
The crossing will occur at a near perpendicular angle and is necessary to access lots 34R and 35R shown on the plan. Headwalls will be utilized as well
as a riprap dissipater that will reduce flow velocities and minimize stream degradation. A temporary diversion pump, coffer dams, dewatering pump, and
discharge hose will be utilized during construction to divert stream flows and minimize the release of sediments during construction activities. Impact 2 is
proposed permanent, permanent -no permanent, and temporary stream impacts for a driveway crossing. The crossing will occur at a near perpendicular
angle and is necessary to access lot 35R as well as to the pasture for their horses, chickens and goats. Headwalls will be utilized as well as a riprap
dissipater that will reduce flow velocities and minimize stream degradation. A temporary diversion pump, coffer dams, dewatering pump, and discharge
hose will be utilized during construction to divert stream flows and minimize the release of sediments during construction activities.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and
silvicultural operations. The Laurel Ridge Phase 2B project is a residential development. Additionally, the project is located within the town of Pittsboro
ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Water
Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers; 2) the Jordan Watershed
Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow"
requirements and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 3) the Phase II NPDES Stormwater
Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction
stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed.

S&EC completed a Threatened & Endangered Species Report, to include a Self -Certification letter through the US Fish & Wildlife Service (USFWS), a
query through the NC Natural Heritage Program database, and an official Species List through the iPac. A formal request was sent to the USFWS on
February 25, 2022. The USFWS has 30 days to respond from the date of the sent request. S&EC received no response from USFWS within the 30 days
meaning that they concurred with the determinations made by S&EC that the proposed actions is not likely to adversely affect any federally -listed
endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Endangered Species Act
(ESA). Please see attached S&EC Threatened & Endangered Species report.

I saw the new changes regarding a pre -filing be done again before a PCN submittal. I am planning on submitting the PCN
in the near future and since there is no current pre -filing application form, I am providing a summary of the project
below. I know DWR is still trying to figure things out, but for now I hope this information will suffice as a Pre -Filing
Request.
This project is Laurel Ridge Phase 2B located at 406 Blufftonwood Drive in Pittsboro, Chatham County, NC. The project is
approximately 70 acres and is a proposed single-family residential development. The project applicant is Laurel Ridge
Development Inc (Attn: Hadley Kirkland). The overall project consists of the construction of a single-family residential
development including but not limited to roadway infrastructure, residential lots, utilities, and SCMs. Specifically, there
are three (3) road crossings that impact streams. Existing conditions onsite consists primarily of undisturbed forested
