Dear Mr. Carter:
Reference is made to your correspondence dated December 21, 2005, in which you requested a 30-day
extension of the 60-day appeal period associated with denials of 401 Water Quality Certifications for the
two referenced projects. These denials were signed by the Director on November 16, 2005. You should
note that this 60-day appeal period is assigned to all projects, whether a 401 Certification is issued or
denied, and wherein the applicant is to work directly with the Office of Administrative Hearings if an
appeal is to be pursued. You are hereby notified that this extension request is denied. Should you wish
to pursue this project further, you will need to re-apply with a new application and a new application fee.
You are advised that, as with the initial application, the proposed impacts will be denied if you propose
any fill that violates the subdivision covenants created to adhere to the 401 Water Quality Certification
issued Apri123, 2998 for the Buckhead Subdivision.
