Regarding the requirement to have an E/SC permit. This development is in the town of Mills
River in Henderson County. They do not participate with the Henderson County SESC or PH2.
The Town's subdivision administrator requires a PH2 stormwater permit for all major
subdivisions. The developer for this project will not be building the houses; they are only selling
lots and constructing the roads
The Town of Mills River's ordinance requires an erosion control plan and permit if land
disturbance is over 1 acre, per state standards. Since the developer is only selling lots and not
constructing the homes, the road will be the only disturbance they will have, and that is around
35,000 square feet. They do not know enough information regarding home site location,
driveways, etc., to adequately provide an erosion control plan for individual homeowners.
Each individual homeowner will be required to obtain all necessary permits, including providing
measures to control erosion. Also, it was a practice until recently in the area to obtain the
stormwater permit before erosion control permit to ensure stormwater quality and volume match
was considered before any grading began.
