The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors, and
assigns, and shall include singular, plural, masculine, feminine or neuter as required by context.
WITNESSETH, that the Grantors for a valuable consideration paid by the Grantee, the receipt of which is
hereby acknowledged by Grantors, has and by these presents do grant, bargain, sell and convey unto the
Grantee in fee simple, reserving unto the Grantors and all owners of lots located in Mikkola Downs
Subdivision as described below, the appurtenant property rights including all easements and uses of the
community water system and community sewage system and all water line and sewer line easements and
appurtenances as more specifically set out below, and all that certain lot or parcel of land situated in Kernersville
Township, Forsyth County, North Carolina, which is more particularly described as follows:
See Property Description at Exhibit A attached hereto which is incorporated herein by
reference (herein, the "Property" or the "Premises").
TO HAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges and appurtenances
thereto belonging to the Grantee in fee simple.
And the Grantors covenant with the Grantee, that the Grantors are seized of their respective interests
in the Premises in fee simple, have the right to convey the same in fee simple, that title is marketable and free
and clear of all encumbrances, and that the Grantors will warrant and defend the title against the lawful
claims of all persons whomsoever, other than the following exceptions, restrictions, and covenants that are
agreed to between Grantors and Grantee (by acceptance of this conveyance, Grantee agrees to the following)
herein that shall run with the lands shown on the various Plat Maps of Mikkola Downs Subdivision:
1. Easements, restrictions, covenants, and rights -of -way of record, if any, including, but not limited
to, the rights of Aqua, Inc., a North Carolina Corporation, or its successors and assigns, the
owner and operator of the community water system and community sewer system and the
owners of all lots located in Mikkola Downs Subdivision, Section One, Phase One (See Plat
Book 32 at Page 172 as amended in Plat Book 33 at Page 45) and Mikkola Downs Subdivision,
Section Two, Phase One (See Plat Book 32 at Page 173) (the foregoing Sections of Mikkola
Downs Subdivision are referred to collectively herein as " Mikkola Downs Subdivision") which
have rights of access and use via individual water and sewer hook-ups to the community water
system and community sewer system, which community water system is serviced by the two (2)
wells and their appurtenances located at the northwestern and northeastern corners of the above -
described Property which include wellheads, pipes, pumps, water tanks, meter houses,
waterlines, and appurtenances; the rights of access and use to the community water system and
community sewage system and all appurtenances thereto are expressly reserved by the Grantors
herein as appurtenant easements, restrictions, and covenants that were a part of the plans of
development for Mikkola Downs Subdivision that were represented by its developers (i.e., the
Grantors herein) to all purchasers of lots therein as being appurtenant easements, restrictions, and
covenants that would run with and be appurtenant to all lots in Mikkola Downs Subdivision;
2. All rights of access and use to the community water system and community sewage system and

all appurtenances thereto that were dedicated, by operation of law, to all owners of lots in
Mikkola Downs Subdivision as appurtenant easements, restrictions, and covenants when its
developers (i.e., the Grantors herein) sold the lots in Mikkola Downs Subdivision pursuant to its
plan of development that included the various recorded Plat Maps of Mikkola Downs
Subdivision set out herein;
3. All rights of Aqua, Inc., and its predecessors in title, as owner and operator of the package sewer
treatment plant located on Lot 23 of Mikkola Downs Subdivision and the existing two (2)
wellheads located at the northwestern and northeastern corners of the above -described Property
that had heretofore been used to service all Lots in Mikkola Downs Subdivision including, but
not limited to, all rights contained in the conveyances recorded in Book 1624 at Page 897, Book
1843 at Page 4004, and Book 2169 at Page 2809 and all rights that accrued to Aqua, Inc., and
its predecessors in title by virtue of its or their possession and operation of the package sewer
treatment plant, wellheads, pipes, pumps, water tanks, meter houses, waterlines, sewer lines,
easements and all appurtenances thereto that were a part of or connected to the said community
water system and community sewage system;
4. The Grantors and Grantee agree as part of the consideration running from Grantee to Grantors
that Grantee shall immediately enter into a written contractual relationship with Aqua, Inc., as
operator of the community water system and community sewage system which has and will
continue to serve the Lots in Mikkola Downs Subdivision and which will serve the Lots in
Havenbrooke Subdivision to be constructed on the above -described Property by Grantee within
24 months of the date of this conveyance, and that the written contract shall be incorporated into
written covenants and restrictions that include the Lots in Mikkola Downs Subdivision and that
such written contract and covenants and restrictions shall be recorded which shall describe the
rights and responsibilities of Aqua, Inc., and the owners of Lots in Mikkola Downs Subdivisions
and the owners of Lots in the new Havenbrooke Subdivision which shall run with and be
appurtenant to all Lots in both subdivisions; and
5. 2022 ad valorem real property taxes to be pro -rated between Grantors and the Grantee through
the date of closing with Grantors paying Grantee Grantor's share at closing with the Grantee
having an obligation to pay the 2022 tax bill on or before December 31, 2022.

The above -described property is known on the Forsyth County Tax Maps as Tax Lots 2.1 and 4B (PIN: 6898-04-
3849.000), Block 5417, and is:
1. Lying contiguous to Pumpkin Ridge Road and being the eastern -most portion of that 52.12-acre tract
conveyed to Erkki Mikkola et al. on November 19, 1986, via the conveyance recorded in Book 1518 at Page 1460;
and
2. Lying contiguous to Pumpkin Ridge Road and Bethel Church Road and being the eastern, southern, and
northwest portion of that 77.62-acre tract conveyed to Erkki Mikkola et al. on November 24, 1986, via the
conveyance recorded in Book 1578 at Page 1450 — the northern -most portion of which was developed into Phase l
and Phase 11 of Mikkola Downs Subdivision recorded in Plat Book 32 at Page 172 as amended in Plat Book 33 at
Page 45 and Plat Book 36 at Page 143 ( Section One), and in Plat Book 32 at Page 173 ( Section Two).
An undivided one-half (1/2) interest in the above -described Property was conveyed to Erkki Mikkola and wife,
Karin Mikkola, as tenants by the entireties, and an undivided one-half (1/2) interest in the above -described Property
was conveyed to Aimo Mikkola and wife, Tuula Mikkola, as tenants by the entireties, via the conveyance recorded
in Book 1578 at Page 1460. Erkki Mikkola died on June 28, 2021, and his Estate was administered in Estate File
number 21 E 2803 in the Office of the Clerk of Superior Court of Forsyth County, North Carolina. Aimo Mikkola
died on July 31, 2013, and his Estate was administered in Estate File number 13 E 1716 in the Office of the Clerk
of Superior Court of Forsyth County, North Carolina. Therefore, Karin Mikkola owns an undivided one-half
(1/2) interest and Tuula Mikkola owns an undivided one-half (112) interest in the above -described Property via
survivorship on the date of this conveyance.

SAVE AND EXCEPT from the above -described 74.875 acre tract of land, the following easements:

(having a radius of 582.41 feet and an arc distance of 170.50 feet) South 15 degrees 05 minutes 24 seconds
East a chord distance of 169.89 feet to the POINT AND PLACE OF BEGINNING; containing 48,534
square feet, more or less, as shown on a survey map by Encompass Surveying & Engineering P.C., PLS,
Firm 4C-4644, dated, February 10, 2022, entitled `Boundary Survey Braxton Development", bearing file
"Drawing 22002bound.dwg".
The above -described property is the northwest portion of the 74.875 acre tract of land (i.e., the
"Development Tract") known on the Forsyth County Tax Maps as Tax Lot 2J (PIN 6898-04-3849.000),
Block 5417, as shown on the Forsyth County Tax Maps; and is further the northwest portion of the property
described in the conveyance recorded in Deed Book 1578 at Page 1452 in the Forsyth County, North
Carolina, Registry.
