They had just started bypassing a main line coming into the plant. Their bypass pumping system malfunctioned, the primary pumping system never turned on due to a damaged float and the secondary pumping system failed to start causing the SSO. The spill was found by town employees at 8:50 am and the contractor was immediately notified of the spill, the pump contractor was onsite and was able to get one pump back running at 9:05 am to stop the spill. We were able to block the spill from further entering the creek by damming up a storm drain downstream. The contractor was reminded of their responsibility and had to install a different float system to prevent any more damage as well as required them to have 24-hour pump watch for the entirety of the project. The area was flushed with clean water and captured at the storm drain, which was then returned to the collections system. The affected area was treated with lime and returned to its normal state with no negative effects to the environment. Please contact me if any additional information is required at this time. Town staff were onsite within 10 minutes, damned up the storm drain and used our vactruck to remove the waste, we then flushed fresh water through the storm drain and captured this as well. We then removed the dam from the storm drain and continued to flush fresh water into the creek, while town staff walked the creel looking for evidence of the SSO, we found several minnows swimming and NO evidence of a fish kill. Management is in conversations with the contractor to ensure this doesn't happen again. We also placed lime on the affected area around I manhole and the area up to the storm drain. I arrived onsite at 0905 and the overflow had stopped. We then damned up the culvert where the flow was entering the creek and started removing the flow. We then ran a fire hose and flushed the culvert with fresh water and removed that with our vac truck until clean (total of 30 minutes time) We then continued to flush fresh water into the creek and walk the creek looking for residual evidence of the overflow. We noticed minnows swimming downstream of the SSO. We placed lime on the affected areas and returned back to normal. Main Street Clayton, NC. 27520 Subject: Little Creek Outfall Replacement Project Sanitary Sewer Overflow (SSO)- Friday, February 11, 2022 Incident# 202200206 Dear Mr. McKeel, On Friday, February 11, 2022, at approximately 8:40 am., Town staff were notified of and responded to a sanitary sewer overflow at the Little Creek Wastewater Treatment facility where Providence Construction is under contract for work replacing, relocating, and upsizing sanitary sewer infrastructure. As you are aware, a significant sewage spill occurred from a section of the system under repair by Providence. It was represented to the Town by your representatives that the incident occurred during a shift change when a bypass pump failed. The Town was further informed by your staff that the bypass pump was unmonitored at the time of failure. Per the Town's investigation, an estimated total of 7,200 gallons of untreated sewage was released into Little Creek and the surrounding area. Due to this SSO, although significant environmental impacts were not sustained, Town staff were required to immediately mobilize and address the overflow. Town staff responded to the site at approx. 8:46 am. to begin clean-up efforts and to conduct investigation as to cause of the overflow. Due to the extent of the spill, numerous Town employees, trucks, equipment, and resources were mobilized to assist in the clean-up. This mass mobilization affected other Town projects which were either planned for the day or already in progress. As part of the clean-up, significant potable water was utilized during the cleanup efforts causing additional burden on Town resources. Per GS 143-215.1C(b) NC DENR rules require the responsible party to report any discharge of untreated wastewater to surface waters equal to or greater than1,000 gallons and issue a press release A press release was issued by the Town's PIO office on February 11, 2022, in accordance with statutory requirements. Section 01270 "Unit Prices" Part 1.20, `By -Pass Pumping of Sewage" Subset "C" of the Contract states that the contractor (Providence Construction) shall be responsible for sewage spills that occur during the bypass pumping. This provision is also set forth in the Supplementary General Conditions, paragraphs SC-7.10 F, G, & H. You may also refer to Addendum No. 2, Section "C" Drawing Requirements, Subset la. dated January 27, 2021, which states `Bypass Pumping shall run 24/7. Contractor is solely responsible for means and methods of maintaining by-pass pumping, as well as Section "D" which states "There is one approach to the by-pass pumping included in the Drawing. The Contractor may provide their proposed plan if different than provided." Furthermore, the contract documents require 24/7, uninterrupted monitoring of the operational pumps. Based on the Town's initial investigation, the pumps were not monitored at the time of the spill which constitutes a violation of the terms of the Contract. This letter is formal notice to Providence Construction that it is responsible for any and all fines, violations, impositions, and any obligations set forth and/or levied by State or other local authority as well as the cost of resources utilized by the Town to clean up the spill. Further, Providence Construction is to assume full responsibility for its actions relative to this matter. Upon receiving a formal response from the State regarding any fines to be imposed upon the Town of Clayton, the Town will provide an itemized cost summary to Providence detailing charges incurred for mobilization, materials, equipment, and work performed by its staff to correct the incident as well as the cost of any assessed fines. Payment of the invoiced amounts shall be due within thirty (30) days. The Town further requests that a written response from Providence Construction (and not sub -contractor) be submitted within (10) ten business days from receipt of this letter, detailing how this malf inction/incident occurred, how the incident was resolved by Providence Construction and its subcontractor, and what measures will be implemented to ensure this type of incident does not happen again. The Town is ultimately responsible for its collection system and must hold its contractors (including Providence) accountable when working on the collections system. Be advised that the 90-day intermediate contract time remains in place in accordance with the executed NTP date of January 3, 2022, and the Town is prepared to assess liquidated damages if the milestone is not completed per contract documents. In the event of further incidents or failure to comply with the conditions within the Contract, the Town will evaluate further action including, but not limited to, contract termination based on Providence's persistent failure to perform work in accordance with the contract documents as outlined in General Conditions Section 16.02. To: PROSPECTIVE BIDDERS AND OTHER CONCERNED PARTIES This ADDENDUM forms a part of the Contract Documents and modifies the original Bidding Documents as noted below. Bidders shall acknowledge receipt of the ADDENDUM in the space provided on the Bid Form. Failure to do so may subject the Bidder to Disqualification. A. Bidding Requirements 1. Document 00100, Advertisement for Bids a. Receipt of Bids: Weather Forecast is presently predicting a winter storm event Thursday morning. An email will be sent out to Bidders of Record by Thursday morning at 10:00 am. The email will either confirm the Bid Opening will be held or Postpone the Bid Opening to Tuesday, February 2, 2021 at 2:00 pm. B. Technical Specification Requirements 1. Section 01270, Unit Prices a. Paragraph 1.15.0 is revised as provided below. Since pipe costs are included in the Base Bid and two Alternates, this revision is to provide one pipe cost for all Bidders to calculate the minimum required line item price for "Cleanup and Seeding Along Outfall." The required percentage has been reduced since this is higher cost pipe. "C. Total Contract Price of cleanup and seeding must be equal to a minimum of ten (10) percent of the total cost of 24-inch Add Alternate 1A. This line item price will remain the same regardless of the selection of the alternates by the Owner." C. Drawing Requirements 1. Drawing No. C-0.03, Demolition Plan a. Add the following to the "Construction Drawing Notes." The following historical wastewater flows are provided for general information for the by-pass pumping on the main sewer lines. Wastewater flow at the treatment plant influent comes from the 18-inch Little Creek Outfall and the 24- inch Johns Street Outfall. The wastewater flows measured at the treatment plant over the past year were approximately as follows: Average Day flows 1.63 MGD The Average Minimum Day flows 1.30 MGD The Average Maximum Day flows 2.80 MGD The Maximum Day flow was 5.27 MGD in August of 2020 The calculated wastewater flow for the existing18-inch pipe at the existing grade when flowing half full is approximately 1.6 MGD.(1,100 gpm) 2756-BP : 01 /27/21 00490-2-1 Addendum No. 2 1.14 (X)' DIA. INTERIOR MANHOLE COATING, DEPTH (X) —(X) FT A. Measurement: By the number of various sizes and at the depth of manholes require interior coating. Measure depths from manhole cover to lowest pipe invert. B. Work: This work is for the cost of interior coating only. Cost of the manhole and associated installation shall be included in previous line items. 1.15 CLEANUP AND SEEDING ALONG OUTFALL A. Measurement: Along pipe centerline. The work includes along proposed sewer main and area of pipe demolition. B. Work: Shall include the full width of the disturbed area for the cleanup and seeding along pipeline construction. Work shall include, but not be limited to, the following: 1. Removal and proper disposal of debris and excess material. 2. Grade disturbed areas to original surface profile prior to trench excavation. 3. Cleaning of paved surfaces. 4. Proper seeding of disturbed area including mulching. 5. Obtain approval of cleanup from owner of right-of-way. C. Total Contract Price of cleanup and seeding must be equal to a minimum of fifteen (15) percent of the total cost of pipeline work. 1.16 GRADING AT MANHOLE #6 A. Measurement shall not be made for this item B. Payment for the grading shall be in accordance with the Contract lump sum price for the total grading as indicated on the Drawings at MH #6. Payment shall be for all the labor, material and accessories required for a complete grading including, but not limited to, clearing and grubbing, rough and fine grading, hauling of material excavated off site, erosion control measures (matting and temporary diversion ditch) and final seeding. 1.17 CREEK CROSSING, STATION 5+40 A. Measurement shall not be made for this item. B. Work: Provide required dikes, temporary piping, by-pass and dewatering pumps, silt bags and appurtenances. C. The required casing and sewer pipe is covered under "36-inch Steel Casing by Open Cut w/ Carrier Pipe." 1.18 CONNECTION AT HEADWORKS A. Measurement shall not be made for this item. B. Work: Core hole for new location of 30-inch pipe. Provide boot connection and grout location of existing hole. 1.19 LOWER 8-INCH RECLAIMED WATER MAIN A. Measurement shall not be made for this item. B. Work: Lower the existing 8-inch ductile iron reclaimed water main for a distance of approximately 30 feet. Provide the necessary ductile iron pipe and fittings required to lower the line. 1.20 BY-PASS PUMPING OF SEWAGE A. Measurement shall not be made for this item. Unit Prices 01270-4 2756-BP : 12/30/20 B. Work: Shall include the required number of temporary sewage by-pass pumping setups as necessary for the installation of the sewer outfall. Provide pumps and piping as necessary for the multiple bypass operations necessary for the sewer installation. Provide 24 / 7 monitoring of the operational pumps. 7.10 C. Contractor is responsible for sewage spills that occur during the by-pass pumping itionally stated in the Supplementary General Conditions, paragraphs SC- $6� , G, and H. D. There is one approach to the by-pass pumping included in the Drawings. The Contractor may provide their proposed plan if different than provided. In either case, the by-pass pumping is the responsibility of the Contractor. 1.21 GREENWAY TRAIL REPLACEMENT A. Measurement: Measure by the square yard. B. Work: Provide stone and asphalt depths for greenway trial repair in accordance with Detail 401.03. Width of trail shall match existing. C. After construction is complete, Contractor shall cut pavement 90 degrees to trail a distance of four feet past damaged pavement on each side of work area. Remove existing asphalt and stone subbase between trail cut lines. Compact subsurface within the trail replacement area 1.22 ANTI -SEEPAGE COLLAR: A. Measurement shall be based on the number installed. B. Work: Provide excavation for collar, formwork and concrete. 1.23 ASPHALT PAVEMENT PATCHING A. Measurement: Measure by the square yard along centerline of pavement in accordance with Detail C01.03. Payment shall not be made for pavement repair required due to excessive open cut caused by Contractor. B. Work: Backfilling, compacting, stone sub -base, asphalt at the depths as specified. Work shall include sections of curb and gutter as may be required as asphalt patches. 1.24 SILT FENCE A. Measure along the base of the silt fence installed. B. Work: Posts, wire mesh, fabric, base trench, stone, and maintenance during construction, removal and clean up. 1.25 REMOVAL OF EXISTING MANHOLES A. Measurement: By the number of manholes removed. B. Work: Complete removal of existing manholes that are in the location of the proposed sewer outfall. Excavating and removal of cone and manhole barrel. Disposal of concrete manhole off site. 1.26 DEMOLITION OF EXISTING MANHOLES A. Measurement: By the number of manholes demolished. B. Work: Excavating, removal of cone. Disposal of concrete debris off site, backfill and compact remainder of manhole to existing grade. 2756-BP : 12/30/20 01270-5 Unit Prices E. Contractor shall be responsible for conforming to the requirements (including associated construction costs) of the N.C. Department of Transportation Encroachment Agreement, and all other local, state, and federal permits associated with the project. Should the Contractor cause the Ownerto receive a Notice of Violation from a governmental agency, Contractor shall pay costs associated with Notice of Violation within ten (10) days of receipt of written notification. Costs shall include, but not be limited to: 1. Fines imposed on the Owner by the agency. 2. Required legal newspaper publications concerning violation. 3. Required mailings to customers concerning notification of violation. 4. Administrative, engineering, and construction costs associated with resolving the Notice of Violation. G. Notice of Violation may include, but not be limited to, the following problems: 1. Sewage spill. 2. Inadequate erosion control measures. 3 Equipment failure during the warranty period. H. In the event of a sewage spill during construction, Contractor shall take the following steps as a minimum: Take immediate action to contain the spill. Notify the Owner and Engineer within 30 minutes of realizing a spill has occurred. 3. Clean up the spill as directed by the Owner. Contractor shall bare all costs associated with cleanup. Connecting existing sewer mains to new sewer mains that have not been completed and certified shall not be allowed. Contractor is solely responsible for means and methods of maintaining by-pass pumping. By-pass pumping shall be capable of handling the hourly peak flows at a typical 2.5 times the projected days flow..
