The March 14, 2022 letter states that the City of Durham is provided an opportunity to present evidence and justification to demonstrate that the proposed civil penalties for the Notice of Violation (NOV) should not be assessed for the sanitary sewer overflows (SSOs) which occurred in the City's sewer collection system between February 1, 2022 and February 28, 2022. As requested, the City of Durham, Department of Water Management (DWM) is providing information about the three incidents that occurred during this timeframe to support the City's position that these events were exceptional, unintentional, temporary, and beyond the City's exercise of reasonable control despite meeting all the conditions of the City's Collection System permit including site visits, inspections, and easement maintenance. Incident # 202200216 - 5216 Penrith Drive— February 14, 2022 On February 14, 2022, an overflow occurred near 5216 Penrith Drive with an estimated 900 gallons of wastewater discharging into Northeast Creek. Crews used a quick response truck to clear the blockage composed of grease and debris. Crews dammed the downstream creek with sandbags, set up a 4-inch pump to pump the untreated wastewater back into the collection system, and flushed the area using a nearby hydrant (dechlorinated water). After the initial cleanup was completed, crews used a Jet -Vac truck to clean the three upstream manholes and three downstream manholes to ensure the pipes were clear of any issues. The City's Stormwater Services Division responded and conducted ammonia testing to help determine the extent of the spill and to advise when the site returned to normal conditions. No immediately visible adverse environmental impacts or hazards to persons or property were observed. The department's Industrial Waste Control/FOG program staff distributed notices to the neighborhood to inform and educate the residents on the effects of grease on the collection system and the appropriate disposal options. The indicated series of reaches were added to the City's Hot Spot program and will be checked by CCTV truck on a periodic basis to minimize further incidents. City of Durham crews have followed up by cleaning the lines upstream and downstream of the incident location and used CCTV trucks to ensure the pipes are cleared. As required, a news release was issued within the 24-hour window. The cost to remediate this spill was $6,130.70. Page 2 of 4 Incident # 202200241— 2518 Indian Trail February 20, 2022 On February 20, 2022, an overflow occurred near 2518 Indian Trail releasing an estimated total of 370 gallons of wastewater into an unnamed tributary of Ellerbe Creek. Crews used a quick response truck to clear the blockage which was caused by root intrusion. Crews dammed the downstream creek with sandbags, set up a 4-inch pump to pump the untreated wastewater back into the collection system, and flushed the area using a nearby hydrant (dechlorinated water). Crews then used a Jet -Vac truck to clean the three upstream manholes and three downstream manholes to ensure the pipes were clear. The City's Stormwater Services Division responded and conducted ammonia testing to help determine the extent of the spill and to advise when the site returned to normal conditions. No immediately visible adverse environmental impacts or hazards to persons or property were observed. City of Durham staff will monitor this portion of the collection system for root intrusion and if the root intrusion becomes an ongoing issue, the area will be included in the City's root control contract. City of Durham crews have followed up by cleaning and CCTVing the lines upstream and downstream of the incident location. As required, a news release was issued within the 24-hour window. The cost to remediate this spill was $7,635.26. Incident# 202200288 — 4126 University Drive — February 28, 2022 On February 28, 2022, an overflow occurred at 4126 University Drive releasing an estimated total of 32,000 gallons of wastewater into the storm drain which feeds an unnamed tributary of Sandy Creek. Initial efforts to clear the blockage were unsuccessful so the crew set up a bypass pump to stop the overflow and transfer wastewater back into the collection system. Additionally, crews dammed the creek downstream with sandbags, set up a 4-inch pump to pump the untreated wastewater back into the collection system, and flushed the creek using a nearby hydrant (dechlorinated water). The City's Stormwater Services Division responded to the site and conducted ammonia testing to help determine when the site returned to normal conditions. No immediately visible adverse environmental impacts or hazards to persons or property were observed. The CCTV crew identified a section of sewer main that had collapsed approximately four feet above the upstream manhole. Based on the CCTV findings, staff determined that the section of main could not be repaired and would require a full sewer line replacement. After further review and consultation with the department's Utility Engineering staff, it was decided that due to the scope of work, the most practical long-term solution would be to reroute the sewer line. The services of a contractor were immediately procured and the repair and pipe replacement work has been completed. CIPP lining of the downstream sewer mains and final lift asphalt still need to be completed. The current total cost of remediation provided by WSM crews and the contractor is $325,006.14. It is estimated that an additional $50,000 will be needed to complete the replacement, bringing the total cost of this remediation and repair to approximately $375,000. Onaoina City -Wide Measures to Reduce the Occurrence of SSOs The City has several programs in place to reduce and/or prevent the occurrence of SSOs. The City has implemented a CMOM plan that expands and enhances its existing programs. Page 3 of 4 System Flushing and Inspection: The City routinely contracts cleaning, CCTV inspection, smoke testing, and manhole inspections of portions of the sewer collection system. The City completes the inspection of the collection system systematically based City defined geographical basins. The City ensures the requirements of the collection system permit are met by deploying City crews to clean at least 10% of the collection system annually with a goal of exceeding the requirement by at least 2 to 5% each year. The City measures the cleaning on a fiscal year basis starting July 1. As of February 28, 2022, 10.13% of City's collection system has been cleaned by City staff and contractors. Sewer Rehabilitation Program: The City has an active Sewer Rehabilitation Program. The program includes flow monitoring (25 permanent monitors), CCTV inspection, manhole inspection, easement mowing, field inspections and investigations, point repairs, line replacement, root and grease abatement and cured -in -place manhole and line rehabilitation. There are 4 full-time equivalent (FTEs) dedicated to the City's system rehabilitation programs in the Utility Engineering Division of DWM. This workgroup handles flow monitoring and system data management and contract preparation, administration, and inspections. There are 20 FTEs in the City's Collections Systems Maintenance workgroup in the Water and Sewer Maintenance (WSM) Division of DWM. This group performs CCTV inspections, hydraulic cleaning activities, mowing, manhole inspections, and manhole repairs. They respond to all reported concerns, including blockages and overflows. In addition, the CSM crews are supported by the Excavation Services workgroup of WSM who perform identified point repairs, line replacements, and cured -in -place lining. In 2018, the department established the Lift Station Maintenance Division to focus oversight and maintenance of the 65 lift stations throughout the service area and the 136 ARVs in the system. This 18 FTE work group conducts the required daily and weekly inspections and associated preventive maintenance activities. The City spends more than $5,000,000 on Sewer Rehabilitation projects annually as a part of its Capital Improvements Programs. Fat, Oils and Grease Program (FOG): The department's FOG education and outreach effort is conducted by 3 FTEs (staff shared 50/50 with the Industrial Waste Control Program). In addition to working closely with the Durham County Health Department, staff routinely inspect over 800 food service establishments (FSEs) annually to ensure appropriate cleaning and maintenance of grease interceptors. Staff participate in a number of community events (Earth Day, Center Fest, and Landlord Workshops) as well as neighborhood meetings to increase awareness of what is appropriate to put in the sewer system. FOG staff conduct post-SSOs follow-up education and enforcement as necessary. The City also invests more than $35,000 per year in advertising (TV commercials, social media, etc.) regarding the proper disposal of FOG. Summary: Based upon the documented information provided above regarding these incidents, the City believes that these SSOs were exceptional, unintentional, temporary, and caused by factors beyond the City's and department's reasonable control. The City actively manages, operates and maintains its system in such a manner as to meet or exceed all the requirements of the Collection System permit. As detailed above, the City systematically inspects, flushes and rehabilitates its wastewater collection system. The Department actively works to educate the community regarding what should and should not be discharged into the City's sewer collection system. NA Comments: Yes 0 No ❑ NA NE On 2/20/2022 at 2 01 pm Water Sewer Maintenance received a call from Daupler system about a Manhole overflowing behind 2518 Indian Trail Crews dispatched and arrived onsite at 2:35pm Upon arrival crews found Manhole 29129 overflowing at a rate of 5gpm Crews flushed with quick response to remove blockage of roots Crews removed blockage 3:15 for a total of 370 gallons of wastewater in a unnamed tributary of Ellerbe Creek. Crews tested creek for ammonia ani found a location at Manhole 19583 where we set up Bypass Pump and blocked the creek with sandbags to insure no untreated wastewater got by. Crews will pump all untreated wastewater back into the sewer system at Manhole 19583. Crews used Hydrant 01055 to push all untreated wastewater to pump for removal Crews will be working for the next few days to eliminate any issues in assets above and below the SSO Manhole. We used bypass pump to pump untreated wastewater back into the sewer system. Crews use JetlVac combo and 2 defused hydrants to help push and remove all waste water that entered unnam tributary. Crews tried flushing to remediate spill but where not successful. After several attempts we decided to set up pump around to bypass untreated wastewater stop the overflow. We were able to get set up at 7pm and overflow was remediated. from 1:40pm to 7:OOpm for a total of 320minutes giving a total of 32,000 gallons of untreated wastewater dumping into a near bye storm drain. The storm drair dumped into Sandy Creek Tributary A. We bypass the sewer from Mh 32908 to Manhole 08995. After bypass we proceeded to try and unblock issue. After CCTV we found line was collapsed 4ft from upstream MH 08982. Contractors were called and line was excavated on 03/01/2022 finding parking lot was failing. Management decided to reroute sewer main through a side road and tie into Manhole 08995. Crews had several JeWac trucks on site washing parking lot dowr and into a Vacuum truck to clear parking lot of any wastewater. Crews are currently working to fix old issue and reroute new sewer main.
