Dear Ms. Higgins,
In a letter dated June 13, 2014, Andy Williams with the Corps of Engineers required that the design of the
alignment for the Courtyards at O'Kelly Chapel project be revised before he would approve the NWP 12. A copy
of Andy's letter has been provided as an Appendix. Specifically, the Andy's concerns were with the sewer stub
located on the west side of the stream (Impact #1), which was designed to meet the Town of Cary's site plan
approval conditions. The construction of the sewer stub would have resulted in 0.02 acres of temporary
wetland impacts to cross the onsite wetland. Andy determined that the crossing was not warranted since the
sewer stub would not connect to a current sewage source or treatment facility. Also, Andy requested that the
sewer alignment be shifted farther north so that the sewer crossed the stream instead of the wetlands in order
to reduce the amount of impacts.
As a result of Andy's requirements, W &R has reached an agreement with the Town of Cary to stub the sewer
line on the east side of the stream /wetlands in order to eliminate the temporary impacts (Impact #1) for this
crossing. The applicant will still establish the 20' sewer easement and dedicate it to the Town of Cary.
However, the construction of the connection to the sewer stub and impacts associated with the connection
will be completed by whoever develops adjacent to the project, and not the EPCON Communities. EPCON
Communities will only be constructing the sewer stub on the eastern side of the stream /wetlands and
dedicating the sewer easement to the Town of Cary. It should also be noted that the sewer stub is located
outside of the 5o' Jordan Lake Buffers.
The revisions to the sewer alignment have resulted in the elimination of the 0.02 acres of temporary wetland
impacts at Impact #1, as well as a revision to the location of the sewer easement where the future connection
to the sewer will take place. Therefore, we are providing an updated PCN in which the impact tables have
been revised to reflect the final impacts. We are also providing copies of the revised Impact Plans which
specify the removal of Impact #1, and the new location of the sewer easement.

REMARKS:
1. Based on a review of your permit application and submitted plans, this proposed project does not meet the
Nationwide Permit (NWP) Condition #23 (Mitigation). Specifically, NWP condition #23 requires that the
activity must be designed to avoid and minimize adverse effects, both temporary and permanent, to waters of
the United States, to the maximum extent practicable at the project site. Also, mitigation in all forms,
including avoiding and minimizing will be required to the extent necessary to ensure that adverse effect to the
aquatic environment are minimal. Your plans indicate crossing #1 will temporarily impact a headwater forest
wetland. However, the section of sewer line associated with this impact does not connect to a sewage source or
treatment facility. As such, there does not appear to be a purpose for this particular crossing and impacts
could be avoided. Additionally, even if there is a purpose for the crossing, it appears that it could be moved to
the north slightly so that it would impact less jurisdictional acreage. Please revise your plans to exclude this
impact or provide additional information indicating the purpose.

The Corps of Engineers conducted a field review of the wetlands and streams within the Courtyards at O'Kelly Chapel
Road project area on January 22, 2014 The JD Request, dated August 16, 2013 and revised exhibits emailed on
December 6, 2013, included the,wetland delineation for the proposed sewer alignment However, due to a lack of written
documentation of access authorization, the Corps did not review the delineation for the proposed sewer alignment The
only jurisdictional features,within the proposed sewer alignment are two intermittent streams We are requesting a JD for
only,the impact areas,withrn,the sewer alignment, which'will be issued in,contunction with issuance of the NWF 12
Since the proposed sewer line crosses both the Town of Cary,and Chatham County jurisdiction, the buffer
determination /requirements for the features within the proposed sewer alignment defaulted to NCDWR NCDWR issued
a Stream /Buffer Determination for the proposed sewer - alignment on February 24, 2014 (JBRRO 13 -386) A copy of the
