RE: Pre - Construction Notification: Nationwide Permit 29 & General Certification No. 3890
The Preserve at White Oak Creek
Apex, Wake County, North Carolina
Dear Mr. Lastinger;
Carolina Ecosystems, Inc., on behalf of Raleigh Land Fund 1, LLC and Bass, Nixon, and
Kennedy Inc., has prepared the attached pre- construction notification for the above referenced
project for a Clean Water Act Section 404 Nationwide Permit 29 and a Section 401 Water
Quality Certification No. 3890. The Preserve at White Oak Creek project is a planned residential
development consisting of single and multi - family homes and a recreational center. The permit
application, originally submitted on 1/28/14, has been revised to include several minor
reductions in wetland impacts as well as additional impacts associated with an off -site sewer
extension necessary to provide sewer for this development. This sewer line is being designed
and constructed as part of the development, but will be owned and operated by the Town of
Apex. Open space and adequate room for stormwater BMPs have been reserved throughout the
site to provide environmental protections and a high quality of life for residents. The project will
help to meet the high demand for residences around the Town of Apex.
The attached PCN form provides information for use in your review of the impacts to streams
and wetlands associated with this site. Supplemental information is provided in this cover letter
including a detailed breakdown of proposed impacts and mitigation. Additional information is
contained in the attachments including a Project Information Sheet, Pre - Construction
Notification form, Vicinity map, USGS map, NRCS Soil Survey map, and Impact Locations
map. BNK has provided the attached overall site plan (Sheet C.1.1) and wetland and stream
impact drawings for your review of this project.
Proposed Impacts and Mitigation
Based on prior conversations with you and NC Division of Water Resources (NCDWR) staff and
our review of the proposed impacts, it is our professional opinion that the project qualifies for a
Nationwide Permit 29 and General Certification 3890. Please note that Impact Site C (PCN
Impact S3) was determined to be a jurisdictional stream lacking significant aquatic function.
Therefore, the impacts to this channel, 129 linear feet, are not considered to count toward the
threshold for the Nationwide Permit 29. Total linear footage of permanent impacts to streams
Mr. James Lastinger Page 2 of 3
June 26; 2014
with important aquatic function for this project is 297 linear feet. Impacts to waters- of-the U.S.
total 436 linear feet of , stream impacts and 0.25 acres of wetland impacts. A breakdown of
permanent and temporary impacts is provided ,in the attached ,Site Impacts and Mitigation tables,
along with proposed mitigation based on our discussions during the field verification visit.
Permanent stream impacts include linear footage of stream within culvert areas and riprap outlet
protection areas. Temporary stream impacts are associated with sewer construction. Permanent
wetland impacts include roadway and embankment "fill to the toe of slopes, and permanently
maintained sewer corridor. Temporary wetland impacts include areas needed for construction
access, sewer construction, and installation of erosion and ,sediment control measures. These
temporary impact areas will be restored to pre - construction grades and stabilized using
appropriate annual species or a wetland seed mix.
Impact site C (PCN S3) was determined during field verification to not exhibit significant
aquatic function. Therefore, no mitigation is proposed to satisfy Nationwide 29 requirements for
this channel. However, NCDWR will require 1:1 mitigation for this impact. As impact site A
(PCN S`1) was determined to be a perennial stream, requiring 2:1 mitigation by your standards
and 1:1 by NCDWR, the overall total for mitigation is similar and compensatory mitigation has
been requested to satisfy the 1`_arger amount of 439 mitigation units (see Table 1).
No mitigation banks with available credits are present within the same basin as this project.
Therefore 'a request for mitigation from the NC Ecosystem Enhancement Program was made, and
the approval is attached. As the construction of this project will be phased, the compensatory
mitigation payments are proposed to be phased as well. Payment will be made to compensate for
all Phase 1 impacts prior to construction in those areas. Similarly, payment will be made, for all
Phase 2 impacts prior to construction. Proof of payment for each phase will be forwarded upon
receipt and prior to construction. The phasing is shown on the attached Site Impacts and
Mitigation table.
Riparian Buffers & Stormwater Management
The Town of Apex has authority under the Jordan Lake watershed rules for the review of
riparian buffer impacts and stormwater management plans. A No Practical Alternatives
Demonstration is being submitted to the°Town concurrently with, this permit, application for their
approval of the proposed buffer impacts, which are provided for informational purposes on the
impact drawings in this application. The general location of BMPs has been provided in the
attached site plan. Final design of these measures, along with associated forms and
documentation, will be submitted to the Town for review. Approval of the stormwater
management plan for the site will be forwarded to NCDWR prior to construction in each phase
of the project.

D. Impact Justification and Mitigation
1 Avoidance and Minimization
la Specifically-describe measures taken to avoid or minimize the proposed 'impacts in designing project`
Roadway connections and extensions to adjacent properties were made as required by the Town of Apex The roadway
alignment was revised at,the northerly stream crossings (impacts B & F) in order to,avoid /minimizeistream, buffer, and
wetland impacts Applicant worked with, the Town of Apex transportation staff-to reduce roadway cros "s section and pavement
widths at stream'crossing locations, in order to minimize impacts tothe „greatest, extent.allowable The Iot,count was reduced
from 350 (authonzed zoning approval) to 31'0 in order to reduce wetland, stream, and buffer'impacts Side slopes at stream
crossings are 2 1 to minimize stream, wetland, and buffer impacts Culverts haveibeen embedded in the stream channels to
ensure aquatic passage A sill will be placed in'the, right barrel at impact site B /S2 in order to retain stream, d i mensions The
sill will be set at the floodplain elevation No buffer encroachment for stormwater; lot grading, or sewer lines is anticipated
Lots will not be platted'in the riparian buffer Stormwater BMPs will be implemented,, upon approval by the Town of Apex, and
conform to the requirements of the Jordan Lake_ buffer rules The off -site sewer line impacts were minimized to one
unavoidable perpendicular crossing
1b Specifically describe measures taken to avoid or minimize the proposed'impacts through construction techniques
Sediment and erosion control measures will be implemented according to NC requirements, and approved by NCDENR prior
to implementation Jurisdictional areas that are not permitted to be impacted and are adjacent to construction areas will be
clearly marked, with protection fencing or other °similar method to avoid °inadvertent encroachment Copies of the issued
permits, and impactareas, will be provided to the pgme- contractorand all "subcontractors working in or near jurisdictional areas
