NORTH CAROLINA Environmental Quality December 6, 2018 Mr. James Vannoy James Vannoy 'and Sons Construction 1608 U.S. Hwy 221 N Jefferson, NC 28640 Subject: Waiver of Monthly Reporting Requirement Jefferson Apparel Company WWTP NPDES Permit NC0030848 Ashe County Dear Mr. Vannoy: As stated by 15A NCAC 02B .0506(a)(1)(E), p'ermittees must continue to submit monthly discharge monitoring reports (DMRs) to the Division, even when there is no discharge from the facility during the reporting period. The Director may waive this requirement during extended periods of no discharge. I have reviewed the request [submitted by your IT manager, Marlton J. Yearick] dated December 5, 2018, which states that the subject facility is not operating currently. After reviewing your request and considering the recommendation of the staff of the Winston-Salem Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility, effective December 1, 2018. The DMRs up through November 2018 should be submitted as usual. Please be aware that should any discharge occur, the discharge must be monitored as per the terms of the NPDES permit. Notify the Winston-Salem Regional Office of any pertinent developments that arise regarding wastewater treatment at this facility, especially if manufacturing activities resume and the system is reactivated. Please also be advised that while requirements for operator visitation, monitoring and reporting are being waived during the period of no discharge, the permittee is still required to pay the Annual Administering and Compliance Monitoring Fee that is associated with this and all NPDES permits. I will have them contact you. The facility that wants to do this is Jefferson Apparel in Ashe County (NC0030848). They haven't had a discharge in years, but have been sending in blank DMRs. To the best of my knowledge they do want to keep the permit just in case for future use. They can't discharge any longer. If a permittee has ceased discharging but wants to keep their permit for future use, they can request a Monitoring Suspension. They would no conger need to monitor, no longer need an ORC, but would still be required to pay the annual fee [to keep the permit active]. If they want to request a monitoring suspension, have them send it directly to me. 1 handle most of those.
