On July 3, 2019, Melissa Joyner, an inspector from the Fayetteville Regional Office of the Division of Energy, Mineral &
Land Resources, conducted a Compliance Evaluation Inspection at the Stone Gables Apartments facility located at 1413
Pittman Grove Church Road, in Hoke County, North Carolina. The purpose of the inspection was to ensure compliance
with State Stormwater Management Permit SW6130901 that was issued on 10/25/2013. A copy of the Compliance
Inspection Report is enclosed for your review. As a result of the inspection and subsequent file review, it has been
determined that the facility is Not Compliant with the conditions of the subject permit and approved plans.
The required actions that are necessary to bring this site into compliance are noted under the Inspection Summary and

Inspection Summary:
The wet detention pond was inspected due to a complaint received by this Office. The following observations were made
during the inspection.:
1. The northeast slopes of the wet detention pond are bare and eroding
2. Vegetation is not observed on the vegetated shelves according to the approved planting plan shown on Sheet C711. If
vegetation on the vegetated shelves is destroyed by Flooding, the plan needs to be followed by replacing vegetation on
the vegetated shelves.
3. A revised and updated drawing should be submitted to the Fayetteville Regional Office showing the footprints of the
new buildings located on Lots 1, 3, 4 and 5 per the allocation of the built upon area (BUA) as noted in the permit.

Inspection Summary:
Ms. Joyner met with Mr. Leon Blue on site. The following observations were noted.: There is additional groundcover
observed on the matted slopes since the previous inspection. The erosion previously observed on the side slope adjacent
to the matted slopes is now stabilized with matting. The northern top slope of the wet detention basin is regraded and
seeded. Erosion is noted on the top,graded slope in need of repair.
In the permanent wet detention basin, vegetation is not observed on the vegetated shelves according to the approved
planting plan shown on Sheet C711. If vegetation on the vegetated shelves is destroyed by flooding, the plan needs to be
followed in replacing vegetation on the vegetated shelves.
A revised and updated drawing should be submitted to the Fayetteville Regional Office showing the footprints of the new
buildings located on Lots 11 3, 4 and 5 per the allocation of the built upon area (BUA) as noted in the permit.

This office received a complaint on 10/1512016 in regards to the breach of the wet detention basin and impacts to the
complainant's property. On 10/28/2016, in response to the complaint, Ms. Joyner met on site with Mr. Leon Blue to view
the wet detention basin which had been repaired with new southeast side slopes installed. The slopes had been
stabilized with matting, with groundcover becoming established. Adjacent to the newly -matted slopes, a side slope with
erosion will need additional stabilization.
Vegetation is not observed on the vegetated shelves according to the approved planting plan. If vegetation on the
vegetated shelves is destroyed by Flooding, the plan needs to be followed in replacing vegetation on the vegetated
shelves and on all other bare slopes.

vegetated shelf and on all other bare slopes.

Inspection Summary:
Melissa Joyner conducted a follow-up inspection on May 17, 2016 at Stone Gables Apartments and met with Greg Hunt,
Joey Jacobs and Leon Blue. The wet detention basin is now completely regraded with seed and matting installed on the
side slopes. Gully erosion was noted on a slope near the outfall on the south side of the basin. There was also erosion
observed on the northeast side of the back slope of the basin.
The top and bottom shelves with the vegetative plantings have not been constructed for the wet detention basin as
specified on the site development plan on Sheet C711. Ownership can not be transferred until the site is completely in
compliance with the State Stormwater Management Permit SW6130901.
A revised and updated drawing should be submitted to the Fayetteville Regional Office showing the footprints of the new
buildings located on Lots 1, 3, 4 and 5 per the allocation of the built upon area (BUA) as noted in the permit.

This project was reinspected to determine the response to the complaint previously received by this office. The drainage
easement near the southeast side of the Basin now has matting installed on the slopes with the erosion repaired. The
southeast side of the Basin is in the process of being restabilized. Slopes are being regraded and matting is being
installed. There are still steep slopes on the northeast, southeast and east sides of the Basin in need of regrading and
stabilization with groundcover. Gully erosion is still noted on the south slope of the Basin. If vegetation on the vegetated
shelf is destroyed by flooding, the approved planting plan needs to be followed in replacing vegetation on the vegetated
shelf and on all other bare slopes.

Provide adequate permanent ground cover on all areas where development has been completed
according to the time limits in the approved plan, including the following areas: On the side
slopes of Channel H, on the bare slopes of the Sediment Basin where it connects with Channel H
and on the slopes behind the metal fence on the south side of the site.
2. Maintain all sedimentation and erosion control measures as specified in the approved plan and as
required to prevent sedimentation damage including the following locations: Channel H.
10. Comments: 1. The erosion on the side slopes of the Sediment Basin is repaired with groundcover noted.
The soil divider of the Basin now has permanent groundcover.
2. The grass -lined channel H has had the erosion repaired, but gully erosion is still noted.
3. There are bare slopes on the south side of the site between the metal fence and the existing
diversion ditch. Sediment and water is leaving the site at an erosive rate and impacting an
off -site diversion ditch. Stabilization is needed with permanent groundcover.
4. There are bare slopes on the Sediment Basin where it connects with Channel H which

obtaining the stormwater management permit while Hackett Builders, LLC would

40-acre development which encompasses and surrounds the apartment site as well
(with the other four lots being future development). Thus, the proposed wet
detention pond was designed according to the requirements detailed in the State
Stormwater BMP Manual. When it came time to make application for the permit,
both parties felt that it was the other party's responsibility to obtain the permit.
After repeated attempts to clarify the issue, Venture Properties assumed
responsibility for obtaining the permit as a result of the issuance of this Notice of
Violation.
Submit a complete permit application package along with the processing fee currently set
at $505 to the appropriate DENR office.
Response: A complete permit application package, including the S505 processing
fee, was submitted to Mr. Bradley Bennett at the Raleigh office. The package was
mailed on August 30, 2013 via Certified Mail (under # 7007-3020-0002-4211-1363)
and was received at said office on September 3, 2013 according to USPS tracking.
As of the date of this letter, we have not received a response from Mr. Bennett
regarding this submission.

This letter is to notify you that you are in violation of Title 15A North Carolina Administrative Code (NCAC) 02H .1014 in
accordance with North Carolina General Statute (G.S.) 143-214.7 for failure to apply for and secure a State Stormwater
Management Permit.
On March 6, 2013 and March 25, 2013, Melissa Joyner of the Fayetteville Regional Office inspected the site and
observed land disturbing activities and construction at the subject development site known as Stonegate Apartments
located off Pittman Grove Church Road in Hoke County, North Carolina.
A file review has confirmed that a State Stormwater Management Permit has not been issued prior to construction at the
subject site as described above. As a result of the site inspection and file review, the following violation is noted:
Failure to Obtain a State Stormwater Management Permit
The subject site as described above is in an area that requires a State Stormwater Management Permit for development
activities according to Title 15A NCAC 02H .1014. The inspection and file review confirms that a State Stormwater
Management Permit was not obtained prior to construction at the subject site as described above.
This Office requests that you respond to this letter, in writing, within 30 calendar days from receipt of this Notice. Your
written response should be sent to this office at the letterhead address and should address the following items:
Please explain when construction (excavation, grubbing, and clearing) began at the site.
2. Please clearly explain why the State Stormwater Management Permit was not secured.
3. Submit a complete permit application package along with the processing fee currently set at $505 to the appropriate
DENR office, which can be determined using the interactive online map at
