DOT staff need to ensure that all necessary cleanup/restoration of the impacted areas (uplands and surface waters) is appropriately completed and sedimentation control measures have been adequately installed/maintained. I was made aware of the sediment loss late on Monday and visited the site yesterday. The deposition was mostly sandy material which was primarily deposited in the upland area in the woods. That material has already been removed. Area Roadside was called in to inspect the site and to review the erosion control measures. During their inspection they discovered that some of the material had possibly reached the back water area of a small private pond. The pond is off site and outside of the project limits. It is also hidden by the tree line and is behind a fence. Joshua Young from Area Roadside, who had inspected the site contacted me to look at the pond. I agreed with his assessment that it looked jurisdictional. Looking from behind the fence it appeared that some of the material had reached the backwater area of pond. The contractor has already contacted the property owner who seems to be agreeable about allowing access to the property for inspection and cleanup. I believe that the delay in the notification and reporting to the agencies was mostly due to the fact that the losses during the initial inspection appeared to only be in the upland area. Losses for both sites combined were estimate at 6-8 CY. The losses were a result of a 2.75” rainfall in approx. 1 hour. Per plan erosion control measures were in place in these areas however were overwhelmed due to the immense rainfall. These areas with sediment deposits have been cleaned and efforts have been taken to add additional EC measures at these locations on the project. Silt deposits were also discovered in a downstream pond on parcel 17 at 325+00 RT -L-. The contractor has had, and continues to have, conversations with the property owner regarding their desire to clean up or mitigate the silt accumulation in the pond however the property owner has not yet agreed to a plan or signed a relevant right of entry. As soon as the property owner decides what corrective they wish to pursue we will let you know. If you have any questions or need further information please let me know.
