Thanks Kim! I am not sure if the letter needs revised, but on the second page - the total SMU reduction is 4 and not 0.06. Also, a total of 2,700.3 stream
credits have been released to date. The credit release totals are good though.

Good afternoon Cara,
As requested, 15% credit is being released for approved restoration and enhancement activities that satisfy the Task 2 As -Built release requirements
pursuant to the Upper Rocky Mitigation Banking Instrument (UMBI). Attached, please find the as -built credit release for:
SAW-2015-01816 / Water & Land Solutions / Upper Rocky UMBI / Upper Rocky Mitigation Site / Mecklenburg County
EPA Comments on the MY-0 Report, Todd Bowers:
Overall, per WLS the following items have been completed regarding completion of Task 2: site earthwork, site planting, installation of monitoring
devices, As -Built Baseline (MYO) Report and Drawings, and the monitoring financial assurance (casualty insurance policy) is active. There were no
deviations to the design plans that would affect credits as noted in the as -built report, except the reduction in R2 credits due to amended conservation
easement. An amendment to the conservation easement deed is currently being finalized for this Project. This revised easement boundary is used in the as -
built report, all figures, and as -built record drawings.
The new conservation easement area is 42.68 acres and R2 is the only creditable area affected by the easement amendment. Noted.
* The Project construction and planting were completed in March 2022 and baseline monitoring activities occurred between January 24th, 2022
and March 15th, 2022. Noted.
* No deviations of significance were documented between the final construction plans and the as -built condition that may affect channel
performance or changes in vegetation species planted. Noted.
* After comparing the preliminary as -built survey and design plan deviations, WLS determined that the channel pattern (sinuosity), dimension
(cross sectional areas), and vertical profile (bedform) were accurately constructed in accordance with the design plans. Noted.
* The MYO longitudinal profiles and plan form geometry, or pattern, fell within acceptable ranges of the design parameters for all restored
reaches. Noted.
The MYO stream channel dimensions generally match the design parameters and are within a stable range of tolerance. Noted.
Two pressure transducers, four crest gauges, and fifteen groundwater wells were installed in January - March 2022. Noted.
* Monitoring of the 12 permanent vegetation plots and three random transects was completed during March 2022. Each vegetation plot is meeting
success criteria with 607 to 1,214 stems per acre. No mention of invasive species presence or absence outside of the veg plots in narrative. Noted
* Deviations from proposed plant list (red line) noted. Diversity and stratum occupation is still ideal for wildlife forage, habitat and ecological
resilience.
Lack of invasive plant species within veg plot data noted.
Plan and Profile Sheets 20-23 are oriented with the north arrow 180 degrees off.
No other substantial IRT comments were received outside of the comments generated during the IRT site visit June 21, 2022. This electronic copy is an
official Department of the Army Notification; no paper copy will be mailed. The conservation easement amendment will be processed separately at the
conclusion of the IRT dispute resolution period. Please let me know if you have any questions or concerns.

Dear Mrs. Conder:
This correspondence is in reference to the Upper Rocky Umbrella Mitigation Bank,
Upper Rocky Mitigation Site, located south of William Hough High School, between NC
115 and Bailey Road, in Huntersville, Mecklenburg County, North Carolina. The
mitigation site is within the Rocky Watershed of the Upper Pee Dee River Basin,
Hydrologic Unit Code (HUC) 03040105. The purpose of this letter is to confirm the as -
built release of credits for this site.
Pursuant to the Umbrella Mitigation Banking Instrument entitled, Upper Rocky
Mitigation Bank, approved June 30, 2020; the site -specific Upper Rocky Mitigation
Project, Final Mitigation Plan, dated February 2020; and the As -Built Baseline Monitoring
Report, Upper Rocky Mitigation Site, dated May 2022, 15 percent of the mitigation site's
total restoration and enhancement credits shall be available for sale immediately upon
completion of all the following:
a. Successful completion of all stream and wetland restoration and enhancement
activities (as -built construction) as described in the plan, dated February 2020;
a. Successful completion of all planting activities as described in the Plan, dated
February 2020; and
b. Successful completion of easement marking/fencing as outlined in the Plan,
dated February 2020.
As referenced in the May 11, 2022 as -built cover letter to the Corps, the Bank
Sponsor indicated there was an adjustment to credits based on the amended
conservation easement to remove a culvert headwall installed by the
subdivision/developer from the easement boundary from R2. The total amended stream
credits are 9,001 and 9.07 riparian wetland credits, for a reduction of 4.0 SMUs. (No
change in wetland credit.)
By copy of this correspondence, we confirm that you have satisfied the above
requirements for the as -built credit release, and 1,349.55 SMUs and 1.286 wetland
mitigation units (WMUs) are now available for sale. To date and with this release,
2,700.3 SMUs and 3.072 WMUs (30 percent of the total restoration and enhancement
credits and 100 percent of the total preservation credits) have been released for sale.
