Dear Mr. Bailey and Ms. Goss,
On behalf of Meritage Homes (the Applicant), Timmons Group (the Agent) is providing additional
information relating to Ferguson Property, an approximately 167.5-acre site located at approximately 1900
New Bethel Church Road in Garner, Wake County, North Carolina (the Site). The first RAI was sent on
June 30, 2021 and a response to the June RAI was submitted on July 28, 2021. The second RAI was sent
on August 18, 2021 and a response to the August RAI was submitted on December 16, 2021.
A partial response was provided for this third RAI on April 15, 2022 in order to allow for review of all feasible
items while additional forcemain data was obtained. A full response to the third RAI was provided on May
13, 2022. This letter is additional information prompted by questions received from the USACE on May 18,
2022 and May 23, 2022.
Updated Impact Maps have been attached (see Attachment 1) reflecting the requested revisions and a
correction on temporary forcemain access (corrected to be consistent with plan to follow an existing ROW
and earthen road from Oregon Trail).
The comments provided by the US Army Corps of Engineers (USACE) are outlined below in blue italics
and are grouped by question. Our response is below each comment.
1) In looking through the FM plans and profiles I also noted that the detail sheets for the crossing of Stream
B and Wetland D seems to be missing. This is the crossing proposed ~700 lf (along the FM corridor) to
the SE of the crossing of Mahlers Creek (Stream A) and Wetland C. Essentially it appears there should
be an additional detail sheet for this crossing between Sheet Nos. CWI-1.9 and CWI-1.10. The profile
drawing (Sheet No. C8.10) also doesn’t appear to show Wetland D in the plan view and doesn’t mention
the stream channels or Delineated Wetland in the profile view. Please provide/update the plansheets
accordingly.
The aforementioned wetland and stream have been added to the Impact Maps on the revised sheet
CWI-1.10, and to the FM plan and profile (Sheet C8.10). The forcemain is proposed to be directionally
bored in this area, avoiding impacts to both features.
2) Please clarify whether or not the 177’ boardwalk shown on Sheet No. CWI-1.6 will require any
temporary impacts to wetlands. Although the plansheet does not show any impacts, your response
letter dated 5/13/2022 states that “Temporary impacts to wetlands will be restored to pre-construction
conditions”.
The need for temporary impacts for both boardwalk installations has been confirmed. This is depicted
on the attached Impact Maps (Sheets CWI-1.4 and CWI-1.6) and reflected in the below updated impact
tables. Temporary impacts to wetlands, stream, and riparian buffer will be restored to pre-construction
conditions, however, installation within the wetland (CWI-1.6) will result in temporary impact, permanent
conversion of PFO to PEM wetland. Large trees will be avoided as much as possible for boardwalk
installation.
3) To facilitate what I hope to be a desktop review of the Fergusson Property FM corridor delineation,
please provide shapefiles or kml/kmz of the Project Study Limits (6.2 acres), wetlands, and streams as
shown on the delineation maps provided in your response letter dated 5/13/2022.
The shapefile was provided and the following confirmation received from the USACE on May 19, 2022:
Based on your submittal and available remotely sensed information the Corps concurs with your
delineation of potential waters of the U.S. within the Fergusson Property FM corridor and no field
verification is necessary.
I will use the maps titled "Figure 6: Wetlands and Waters of the U.S. Delineation Map" Sheet Nos.
1-5 (attached) from your 5/13/2022 submittal when processing the permit application/request for
this portion of the site.
4) Things sounds positive in my coordination with USFWS on this project. They have sent me a list of
proposed Special Conditions for me to include upon permit issuance so they can concur with a May
Affect not Likely to Adversely Affect determination for the subject federally listed aquatic species.
Please review the following one to make sure your client could abide by it (assume we’re referring to
the entirety of the Fergusson s/d and forcemain project):
The extent of tree removal and grading required for the construction activities must be minimized by
planning and scheduling activities in sequence, as appropriate. Areas where tree removal is not
required and access is not otherwise needed for construction of infrastructure, buildings, or amenities
must be fenced during construction to prohibit vehicle entry. Graded or disturbed soils must be
stabilized with native grasses or mulch covers within 14 days of completion of the disturbance activity.
The client has confirmed they can abide by the aforementioned special condition.

Impact 1 consists of 0.144 acres of permanent direct impacts due to road and greenway fill and 0.030 acres
of potential permanent indirect impacts due to a loss of hydrology to portions of the wetland.
Impact 6 consists of 0.062 acres of temporary impact, permanent conversion of PFO to PEM, due to the
installation of an aboveground sanitary sewer to connect the proposed utilities to an existing pump station.
Impact 7 consists of 0.072-acres of temporary impact, permanent conversion of PFO to PEM, for the
installation of a boardwalk.
Impacts 8 and 9 consists of 0.028 acres and 0.058-acres, respectively of temporary impact resulting in
permanent conversion of PFO to PEM wetlands due to the installation of the forcemain. The temporary
impacts will consist of clearing vegetation and grubbing roots if necessary as well as the excavation of a
trench for burial of the proposed line. Temporary matting will be used to minimize disturbance to soils within
the staging areas. The staging areas will be re-seeded as necessary using the NC Piedmont FACW Mix
from Ernst Seeds and restored to pre-construction conditions. The trench will be backfilled with excavated
material removed during excavation and/or suitable topsoil to restore to pre-construction contours.
