On April 28, 2014, the Division of Water Resources (Division) received your application dated April
*.� t Quality Certification and Riparian Buffer Authorization from the
Division for your project. The Division has determined that your application cannot be processed.
- ....arir3n is fai; -r!i! d until the following information is received:
1. The footprint of the retaining wall proposed in this application requires a minor variance
from the Tar - Pamlico Riparian Buffer Rules. The application for the variance is included
with this letter for your use. It appears that the impact is 10 inches wide by 54 feet long
(50 -foot wall with two -foot wings on each end) for a total impact of 45 square feet. This
impact requires 68 square feet of mitigation. This mitigation requiren',eirt be sat s'W-=d
by purchasing 68 square feet of riparian buffer mitigation from the Ecosystem
.:;zI—? <=,;;- - — oc an approved mitigation bank. Or the applicant can satisfy this
mitigation requirement by planting one containerized tree that is native to the piedmont of
North Carolin_athe riparian buffer.
2. There is no application fee for a variance from the Riparian Buffer Rules. Please keep in

3. While on site on May 16, 2014, a considerable amount of erosion was observed on the
slope adjacent'to ,the dock. This situation needs to be resolved in a timely manner to, avoid
issuance of a 'Notice of Violation for violating water quality standards.
