Box 278 Angier, North Carolina 27501-0278 Subject: Notice of Violation of Permit Conditions Minimum Freeboard Requirement and Reporting Requirements Angier WWTP, Permit #WQ0002638 Harnett County Dear Mayor Cobb: In response to the inclement weatherexperienced in the past several months, regional staff members have closely monitored the freeboard conditions of waste treatment facilities using lagoon treatment as an element of a non - discharge (spray irrigation) disposal system. The purpose of this effort was to obtain information about the operating conditions and capabilities of each facility. During this process, it has been determined that the Town of Angier's waste treatment/storage lagoon has failed to consistently maintain the minimum freeboard of two feet as required in the subject permit. This has been documented on the Town's Non -Discharge Application Reports filed routinely by the treatment plant operator, Mr. Jimmy Cook. As stated in the General Conditions of that Permit, Item VI.4., "Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-215.6C." Given the circumstances surrounding this violation, the Town is hereby requested to provide this office with 1.) A detailed explanation of circumstances leading to the violations; and 2) A plan indicating the measures which will be taken to bring this treatment facility into consistent compliance with the terms of the permit. Under Permit Item III. Monitoring and Reporting Requirements, Section 5, the Permittee isrequired to "report by telephone to the Fayetteville Regional Office....no more than 24 hours or on the next working day... any of the following: (d) Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations." The high freeboard levels were not reported within the time frame, which constitutes a•second violation of permit conditions. This has been brought to the attention of Mr. Cook and full compliance with this condition is anticipated. Please understand that this Notice does not prevent the Division of Water Quality from taking additional enforcement action for these or any future violations. North Carolina General Statutes have provisions for assessment of civil penalties of up to $10,000 per day of violation. A prompt response and resolution to the problem at hand will be taken into consideration should additional enforcement action be deemed necessary. Extraneous flow into the Town's collection system is obviously a major contributor to the freeboard problem. It is the recommendation of this office that efforts be increased to identify and eliminate areas of inflow and infiltration.
