out our day-to-day program obligations. Please read carefully the following guidelines signing the form:
1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule an
appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm. Viewing time ends at
4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision
is available.
2. You must specify files you want to review by facility name. The number of files that you may review at one time will
be limited to five.

4. You may make copies of a file at $.05 per copy. First 100 copies at no charge. Payment may be made by check or
money order at the reception desk. You may also scan to email or a thumb drive.
5. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not betaken from the office. To remove,
alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can be fined up to
$500.00. No briefcases, large totes, etc. are permitted in the file review area.
6. You may take photos of large plans with your phone camera. Necessary large plan copies can be scheduled with
Cameron.Weaver@nedennegov 910-796-7265 for a later date/time at an offsite location at your expense. Requests for
large plan copies should be attached on top of the file after completion of the review. Allways Graphics can be contacted
to set up payment options.
7. Written questions may be left with this completed form and a staff member will be in contact with you IF you
provide your contact information where indicated above.
8. In accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and collected for checks on which
payment has been refused.

Dear Mr. Cox,
This letter is to inform the North Carolina Division of Water Quality Wilmington Regional Office
the specific action AAIPharma will take to correct the deficiencies listed in the Notice of
Inspection and Non -Compliance dated September 9, 2008.
Section 4:
Required Action Item 1. Noted a failure to maintain the required maintenance (specifically:
remove all woody vegetation from the side slopes).
Response: This was completed on September 18, 2008.
Required Action Item 2. Existing permit SW8 980308 expired April 30, 2008, renewal is
required.
Response: AAIPharma has contracted Kent P. Harrell, P.E. with Norris, Kuske & Tunstall
Consulting Engineers, Inc. to complete the required State Storm water Permit Renewal and Name
/Ownership Change forms and submit the NC DENR for approval.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on August 28, 2008 to determine compliance with Stormwater Permit
Number SW8 SW8 980308 issued on April 30, 2008.
A summary of the findings and comments are noted under Section 4 of the report. Please
inform this Office in writing before October 9, 2008, of the specific actions that will be
undertaken and the time frame required to correct the deficiencies. Failure to provide the
requested information, when required, may initiate enforcement action. If you have any

Please remove all woody vegetation from the side slopes.
2. Please be reminded that your state stormwater permit expired on April 30,
2008 and the operation of a stormwater treatment facility without a valid
permit, is a violation of NC General Statue 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties
of up to 10,000 per day. This office sent you a renewal package on
August 15, 2008 to this date we have received no response.

Subject: Fountain in Wet Pond
On April 30, 1998, the Division of Water quality issued you a Stormwater Management
Permit for Applied Analytical Office Building Expansion. An inspection of the facility by the
city of Wilmington indicated that the permitted wet detention pond is being operated with an
aeration fountain. Per the requirements of your permit, the operation of a fountain is not allowed
as it may cause the TSS removal efficiency of the pond to be reduced by as much as 40%. This
is not in compliance with the 85% minimum TSS removal design requirement that the permit
was issued under. Please remove or disable the fountain immediately.
