Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit contains the following changes to its terms from those found in the draft permit sent to you on April 13, 2011. • The effluent limit for Total Residual Chlorine has been corrected from 17 µg/L to 28 µg/L. • Language within the chronic toxicity monitoring condition regarding the reporting of monitoring data collected more frequently than required by the permit has been removed. • The map has been modified. • Updates have been made reflecting administrative changes within the permitting agency that have occurred since the draft permit was prepared. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. Toxicity testing should be performed during the months of March, June, September • and December, and sampling should coincide with sampling for parameters covered by footnote 2. All samples must be collected from a typical discharge event. There shall be no discharge of floating solids or visible foam in other than trace amounts. Page 3 of 5 Permit NC0083828 A. (2.) CHRONIC TOXICITY MONITORING (QUARTERLY) The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 8 %. The testing shall be performed as a Ceriodaphnia dubia 7-day pass/fail test. The tests will be performed during the months of March, June, September and December. These months signify the first month of each three month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. . All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. We understand that we will have the opportunity to meet with you and your staff at a Q & A meeting on Monday, May 23, 2011 in Greensboro to discuss this issue, but we wanted to submit these comments to you by May 18, 2011 in order to comply with the 30-day comment period. Comments and Concerns 1) WET Testing Our primary concern is the addition of quarterly WET testing to the requirements in the DRAFT permit. We understand that addressing impaired waters is a high priority with the division. The City of Burlington is committed to protecting the environment and enhancing the environment when the opportunity and resources permit. The cost to add quarterly toxicity testing will be significant with no corresponding benefit to the aquatic environment, especially considering that the division emphasizes in the DRAFT permit that there is no compliance limit associated with the results of these tests. Recommendations — The City of Burlington understands that two of the main factors influencing this additional permit requirement is the fact that the receiving stream was listed on the 303(d) list of impaired waters AND the fact that the water treatment plant will transition the secondary disinfectant to chloramines during the 2011 calendar year. We would like to propose eliminating the WET testing at 8% and replace the WET test with additional chlorine testing and ammonia testing of the lagoon effluent. In addition, the results of ammonia and chlorine testing is very likely to identify any potential issues with toxicity as well as, if not better than WET testing. 2) Fluoride Testing The City of Burlington laboratory is not certified to report fluoride results for NPDES purposes. The purpose for adding this test at this time is unclear. The City of Burlington — like most water treatment plants in North Carolina — has been adding supplemental fluoride to drinking water for decades. Fluoride is a naturally occurring element that is present in many sources of surface water. We are not aware of any studies that have linked toxicity to fluoride concentration. In addition, per the recommendation of the CDC that was issued in January 2011, the City of Burlington has decreased the supplemental fluoride dosage in drinking water from 1-1.2 mg/L to the current target concentration of 0.7 mg/L. We question why this parameter would be included in our DRAFT permit. Recommendations — The City of Burlington would like to recommend removing this requirement from the permit or modifying the parameter to allow us to report the results without the need to run certified samples. Summary We do not believe that the proposed changes to the NPDES permit will provide any enhancement to the aquatic community over and above the measures we are currently implementing. We do understand the concern that is raised by the addition of ammonia to the disinfection process; however, we believe we are offering a practical and informative alternative by implementing additional ammonia testing. We believe the impairment status of the receiving stream is a priority, but the responsibility of the state should not place the additional monitoring cost burden (> $1,500 per year over a 5-year permit cycle) on the regulated permit holders without any expected environmental mitigation. Mackintosh, Jr. Water Treatment Plant is a conventional water treatment plant originally constructed in 1981. The plant was expanded in 1993 when the dam was constructed to create Lake Mackintosh. Located on the shores of Lake Mackintosh at 3400 Hams Road, Burlington this plant can treat up to 18 million gallons per day. The water treatment process consists of flash mix, coagulation, flocculation, settling, filtration, chemical addition, disinfection, and pumping. The plant produces wastewater from draining and cleaning the floc basin, settling basins, and backwashing the filters. These waters have associated solids that have been treated with aluminum sulfate and sodium hydroxide for coagulation. The filter back wash can have chlorine residual resulting from disinfection of the filters and the use of finished water during the backwash procedure. The water generated by cleaning the basins and the filters flows to the two lagoons where the solids separate from the liquid by settling. There is no sanitary waste included in this wastewater. Two pumps located between the lagoons pump the wastewater to Great Alamance Creek behind the dam of Lake Mackintosh. We dechlorinate the water going into the creek with calcium thiosulfate which is fed at the pump well of the lagoons. We plan to replace the lagoon pumps this year with pumps capable of pumping sludge. We will then be able to pump the thin blanket of sludge at the top of the lagoons to holding basins making removal of sludge and hauling it to a farm more efficient. The thin sludge can then be sent back to the lagoons for thickening or we have the capability of pumping it to drying beds. The wastewater is monitored by a flow meter that can be compared against the pump run times to verify the flows. Box 1358 Burlington, NC 27216-1358 NPDES Permit# NC 0083828 Sludge Management Narrative City of Burlington NPDES Permit Permit #: NC0083828 Date: December 28, 2010 Our method of disposal of the water treatment plant sludge satisfies the requirements of the 40 CFR 503 biosolids regulations and the 40 CFR 257 Solid waste disposal regulations. The treatment plant participates in a land application sludge management program under non -discharge permit number WQ0000520 issued by NCDENR/DWQ to the City of Burlington. The sludge management program includes disposal of the water plant sludge (3,286,399 gallons in 2009) on participating farmland. The treatment plant settling lagoons thicken the sludge by gravity. Thickened sludge can be combined with wastewater plant biosolids for land application, or applied directly to farmland. Our practice is to top dress the water plant sludge with either nitrogen fertilizer, potassium, or bio solids to improve the nutrient value to the farmer. The City has permitted 3,502.70 acres for the sludge management program. The City contracts with a biosolids management company to perform the site applications and assist with record keeping and reporting. Annual reports are submitted to the USEPA and the NCDENR.
