I am in receipt of the Notice of Violation & Intent to Assess Civil Penalty dated June 17, 2022. The
violation of the late submittal of the electronic Discharge Monitoring Report (eDMR) for the month of
March 2022. With the quarantine requirements for the primary operator in responsible charge (ORC) and
multiple illnesses that occurred during this time period, collection and submittal of information was
difficult. Additionally, we were assessed a Notice of Violation & Assessment of Civil Penalty (Case No.
LR-2022-005) dated June 9, 2022 which we are working to obtain funding for at this present time.
I am attaching an email that was sent to your office from the ORC requesting remission of monetary
penalties for late reporting and gives additional details that lead to the late reporting.

Mr. Basinger,
This email is intended to follow-up my voice mail of yesterday and this morning, as well as,
to convey my desire to request Remission from penalty regarding Case No. LR-2022-0004
and other similar Assessments / Cases during the period of time alluded to below. I have
not seen nor do have a copy of any other letters but it is my understanding that not only
Lake Norman was sited but also the following facilities:

.... I knew of the NOD's but I just recently learned of the monetary penalties. As you know
Covid and Covid related issues had me quarantined from my office. I was basically living in
my camper and downstairs in my home. My wife who works from home is on full time
oxygen and is considered high risk. We share an office. I tested positive for Covid twice
between January 2022 and April 2022. And after getting a negative test waited the
suggested 10 days to be around my family. During this time my reports and many of my
personal matters got behind. Although I worked though it and performed the required
visitation and sampling, the paperwork piled up. Communicating through several emails, I

did keep your office abreast of my condition and my plans to get caught up. I did not get a
written response so I assumed we were on the same page. I did talk to Roberto on the
phone and he told me the late reporting would be recognized as a deficiency not a
violation and that NOD's had been sent out. Sometime much later I talked to Wes...he
called about an unrelated issue...wherein I mentioned the reports and told him I should be
getting caught up soon. He told me that I could possibly get a violation and fine. All EDMR's
were up to date soon thereafter.
We can discuss this in greater detail at your convenience, Just wanted to get you
something in writing asap to comply with the 30 day deadline. Please advise.
