VVe only debit the mitigation after a permit is issued and the mitigation responsibility transfer form has been signed and sent back to the USACE. If the design of the project has changed and mitigation will no longer be needed,then we can cancel this request. If a permit has been issued by either the USACE or NCDWR then I will need to get a copy of the original issued permit and a copy of a revised permit stating that mitigation was no longer required. Please let me know if you have any questions or need any additional information from me. From: King, Art C Sent: Thursday, June 26, 2014 9:15 AM To: Hair, Sarah E SAW (Sarah.E.Hair(a)usace.army.mil); Wainwright, David Cc: Williams, Kelly Subject: Bridge 419 Randolph (Draper Street) stream relocation Liz, David, Because of a mistake made by the company contracted to relocate the water line on this project,the proposed stream relocation was made impractical.The contractor encounter rock during the jack and bore under the stream that caused the bore to go off line and miss it's mark.The mistake forced the water line closer to the roadway by about 6-8 ft.This error has put the water line into direct conflict with the proposed stream relocation.The only viable alternative was to not move the stream.The stream bank next to the roadway that was stripped of vegetation to complete construction of the bridge end bent and approach slab, and to make space for the installation of the guard rail, has been armored with large rip-rap and left in place (see attached pictures) . Because we were able to avoid the in channel work on the stream, it makes the 71ft of mitigation we obtained from EEP for this project unnecessary. Hopefully Ms. Williams at EEP can update us on the status of the mitigation based on our new situation. If you have any questions or require additional information, please contact me.
