Accordingly, we are forwarding the attached NPDES discharge permit. It is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. There are two changes to this final permit from the draft permit sent to you on March 14, 2012. Flow measurement has reverted to the old permit, with the requirement to record discharge duration in addition to the instantaneous flow rate so that total gallons per day can be calculated. The limits on Total Aluminum have been re-evaluated and removed. Monitoring is changed to Quarterly. Filter backwash water and clarifier flush water average flowrate is less than 0.050 MGD. Treatment consists of one concrete lined sludge settling lagoon and dechlorination. Parameter should be sampled in conjunction with Quarterly Toxicity Testing. 4. Chronic Toxicity (Ceriodaphnia Pass/Fail monitoring at 8%): January, April, July & October (see Part I. A. (2.) All samples must be collected from a typical discharge event. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC0083178 A. (2.) CHRONIC TOXICITY MONITORING (Quarterly) The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 8%. The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of January, April, ...flak and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit maybe re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A compliance schedule can be provided if you need some time to obtain funding, procure and install a flow instrument. Please request one in your comments during the Draft Review period." These facilities can accurately measure wastewater discharges into the sed basins, meter the effluent, and report the flow onto the DMRs. Typically these are batch discharges and continuous flow recording is not applicable here. Very few, if any of our water plants, have the ability to measure the flow on the effluent. They do however calculate the flows entering these basins prior to discharge and all other compliance samples are collected at the outfall. It is the opinion of the ARO that requiring these facilities to retrofit their basins with a flow monitoring device along with meters to record flow would be redundant and an expenditure that is unnecessary at this time. The facility is designed to provide2.0 Million Gallons per Day of treated water. The backwash wastewater is estimated to be 0.03375 Million Gallons per Day. The facility discharges the backwash wastewater to Reems Creek in the French Broad River Basin. The receiving stream (Reems Creek) is classified C, Trout waters in the French Broad River Basin. This reach is not listed on the 2012 Draft 303(d) list. All North Carolina streams are listed as Impaired for Mercury based on fish consumption advisories. Permitting Strategy: Permitting Strategy for Conventional Water Treatment Plants is followed for this facility. Discharge Data Review and RPA DMR data for 2009, 2010, and 2011 was reviewed. Flow averaged less than 0.050 MGD; there is no flow limit. RPA was performed for iron and Aluminum. Iron does not show RP, so monitoring is changed to Quarterly. Aluminum does not show RP, monitoring will be quarterly per the permitting strategy. Monitoring for copper will be changed to quarterly too. Whole Effluent Toxicity Testing The facility does perform Chronic Toxicity testing using Ceriodaphnia dubia at 8%. All tests were passed during the period reviewed (2009 - 2011). All solids come from filtration of surface water that is being treated for potable domestic use. Solids consist of organic matter along with iron and aluminum sulfate. Solids are allowed to settle out in our concrete holding lagoon. The settled solids are pumped out in a slurry and trucked to a municipal sewage treatment plant for disposal. This occurs 2-4 times per year.
