Personnel in the NC DENR Winston-Salem Regional Office conducted a review of the permit file for
your facility. The review noted printing errors on the Effluent Limitations and Monitoring
Requirements pages in the text describing pH sampling. This permit modification corrects the
typographical errors.
Please find enclosed the revised permit pages. These pages should be inserted into your permit.
The old pages may then be discarded. All other terms and conditions contained in the original permit
remain unchanged and in full effect. This permit modification is issued under the requirements of
North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North
Carolina and the U. S. Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter. This request must be a written petition
conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.

dated December 6, 1983.

RESPONSE:
This agency has reviewed the draft permit and determined that the proposed
discharge will not be sufficiently close to any existing or know proposed
public water supply intake so as to create an adverse effect on water quality.
We concur with the issuance of this permit provided the facility is operated
and maintained properly, the stated effluent limits are met prior to discharge,
and the discharge does not contravene the designated water quality standards.

documenting alternatives to direct surface water discharge 180 days prior to permit
expiration date. To date this document has not bee received with the renewal request.
The facility discharges into a zero flow stream. Therefore, the facility is required to
meet very stringent effluent limits. Several facilities across the state have been faced
with the same problem and have either upgraded the facility to meet the restrictive limits
or moved the discharge location. We understand this is a burden on the facility, but we
need to be consistent across the board. The facility needs to seriously consider
r;tying the discharge from this unnamed tributary due to the fact of documented
quality problems on this watershed.
e to the fact that the facility has not identified any alternatives to direct surface water
discharge, the facility will be required to meet 5 and 2 limits. The permit renewal was
drafted with a compliance schedule of three years to meet the revised limits.
The following notes were taken during the review of the application package:
• 303(d) List Review: Facility is not listed on North Carolina's 1998 303(d)
List.
• Review of Basin Plan: No specific information was documented for the
subject UT to the Yadkin River.
• Notice of Violation and Assessment of Civil Penalty:
On December18, 1998, a $1,553 fine was sent to the Hilltop Living Center.
The fine was assessed due to violations of the MBAS, BOD, and Fecal
Coliform limits.
• Wasteload Allocation (prepared 03/06/89): MBAS monitoring was
included to cover the kitchen and laundry operations at the facility. BOD
TSS and fecal limits were determined to be secondary. DO was limited at 5
mg/l. Instream monitoring was recommended for temperature, DO, and fecal
coliform and conductivity.
The facility discharges into a stream classified as zero flow (both 7Q10 and
30Q2 are zero). The WLA included language indicating the discharge should
be removed when an alternative becomes available.
The permit renewal was drafted with 5 and 2 limits based on the fact that
they are discharging into a zero flow stream. The current limits will remain
effective the first three years of the renewal. After this time, the 5 and 2
limits will become effective. Region please comment o, the time frame

• DMR Review:
Average flow data appears to be running very close to the permitted flow.
The facility is averaging around 0.0028 MGD in 1998. Four BOD violations
were reported in 1998 and one in 1997. Compliance evaluation inspection
report dated 4/28/98 identified several deficiencies in the facilities
monitoring requirements (I will not summarize problems since the Region is
already aware of the specific issues).
Effluent DO levels for 97 and 98 were above the limit of 5.0 mg/1 (data
ranged from about 6 mg/1 to 7.3 mg/1)
Facility is not collecting upstream samples (possibly due to the fact that the
facility discharges into a zero flow stream.
DO downstream reported for October 1998 was 4 mg/1. Fecal Coliform
levels downstream were very high in April 1998. Facility is not consistent
with information reported for instream data.

E. The facility discharges into a stream with 7Q10/30Q2=0 cfs. Removal of discharge is
recommended if a more environmentally sound alternative is available at an economically
reasonable cost. An engineering report evaluating alternatives to discharge is due 180 days prior to
permit expiration along with the permit renewal application. As part of the report, the cost of
constructing a treatment plant at the discharge point to meet limits of 5 mg/1 BOD5, 2 mg/1 NH3 as
N, 6.0 mg/1 DO, and 17.0 ug/1 chlorine should also be included if there are no feasible alternatives
to a surface discharge. Upon review of the results of the engineering report, the Division retains
the right to reopen and modify this NPDES permit to require removal of the discharge or to revise
the permit limitations within a specified time schedule.

The Division is beginning the second five-year cycle of river basin planning and permit renewals. An
examination of the basin planning schedule has revealed that the timing of permit renewals does not
allow an evenly distributed workload as first envisioned. This results in problems with the efficiency
and effectiveness of the NPDES program. In an effort improve customer service, and after thorough
review of the water quality issues in your area, the Division is changing the permit renewal schedule for
all NPDES permits in your sub -basin.
This permit modification changes the expiration date of the subject permit to May 31, 1999. Please find
enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old
page. All other terms and conditions contained in the original permit remain unchanged and in full
effect. This permit modification is issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If you have already submitted a permit renewal application for the subject facility, the Division will
retain the application until your permit is due for renewal. No additional forms or fees will be required.
If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be a written petition conforming to
Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be final and binding.
