The review noted printing errors on the Effluent Limitations and Monitoring Requirements pages in the text describing pH sampling. This permit modification corrects the typographical errors. Please find enclosed the revised permit pages. These pages should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. Several facilities across the state have been faced with the same problem and have either upgraded the facility to meet the restrictive limits or moved the discharge location. We understand this is a burden on the facility, but we need to be consistent across the board. The facility needs to seriously consider r;tying the discharge from this unnamed tributary due to the fact of documented quality problems on this watershed. e to the fact that the facility has not identified any alternatives to direct surface water discharge, the facility will be required to meet 5 and 2 limits. The permit renewal was drafted with a compliance schedule of three years to meet the revised limits. The following notes were taken during the review of the application package: • 303(d) List Review: Facility is not listed on North Carolina's 1998 303(d) List. • Review of Basin Plan: No specific information was documented for the subject UT to the Yadkin River. • Notice of Violation and Assessment of Civil Penalty: On December18, 1998, a $1,553 fine was sent to the Hilltop Living Center. The fine was assessed due to violations of the MBAS, BOD, and Fecal Coliform limits. • Wasteload Allocation (prepared 03/06/89): MBAS monitoring was included to cover the kitchen and laundry operations at the facility. BOD TSS and fecal limits were determined to be secondary. DO was limited at 5 mg/l. Instream monitoring was recommended for temperature, DO, and fecal coliform and conductivity. The facility discharges into a stream classified as zero flow (both 7Q10 and 30Q2 are zero). The WLA included language indicating the discharge should be removed when an alternative becomes available. The permit renewal was drafted with 5 and 2 limits based on the fact that they are discharging into a zero flow stream. The current limits will remain effective the first three years of the renewal. After this time, the 5 and 2 limits will become effective. The facility is averaging around 0.0028 MGD in 1998. Four BOD violations were reported in 1998 and one in 1997. Compliance evaluation inspection report dated 4/28/98 identified several deficiencies in the facilities monitoring requirements (I will not summarize problems since the Region is already aware of the specific issues). Effluent DO levels for 97 and 98 were above the limit of 5.0 mg/1 (data ranged from about 6 mg/1 to 7.3 mg/1) Facility is not collecting upstream samples (possibly due to the fact that the facility discharges into a zero flow stream. DO downstream reported for October 1998 was 4 mg/1. Fecal Coliform levels downstream were very high in April 1998. Facility is not consistent with information reported for instream data.
