Dear Ms. Loflin:
Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no changes from the draft permit sent to you on April 8, 2009.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that
may be required.

set forth in Parts I, II, III, and IV hereof.
The permit shall become effective September 1, 2009.
This permit and the authorization to discharge shall expire at midnight on May 31, 2014.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked; and as of this issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under
the permit conditions, requirements, terms, and provisions included herein.

the permit. However, the Permittee shall continue to record and submit all values reported by a North
Carolina certified laboratory (including field certified), even if these values fall below 50 µg/L.
There shall be no discharge of floating solids or visible foam in other than trace amounts. •

Bob,
You are correct, I don't think these WTP discharges would adversely affect the receiving streams such that they'd disrupt
downstream WTP operations.
I checked back through my file on NPDES sign -offs, and NC0036561 United Church Retirement Home, NC0059536 Hilltop
Living Center were both signed off on 4/14/09, and sent to our Raleigh office (I received both of these on 4/9, along with
NC0070637 Kurz Transfer Products). I concurred with permit issuance on all of these.

Hi Lee,
Thank you for your comments and your concerns. I know the facilities you oversee appreciate it too. I wanted you to
know that we understand your concerns and that we are reevaluating the current strategy for WTPs and its
implementation. However, that will take some time to complete. In the meantime, consistency and timeliness will keep
us working with the existing permitting strategy. We'll try to stay on top of the footnoted clauses in the permits that
would reduce or remove monitoring if the data show no impacts to the receiving streams, in order to quickly remove
any unnecessary requirements.
One further question regarding these three particular facilities. Each discharges to water supply waters, which initiates
our query for your sign off on the permits. I assume, based on your other comments, that you don't think these
discharges would adversely affect the receiving streams such that they'd disrupt downstream WTP operations. Will the
memos acknowledging that approval (as opposed to your memo objecting to some terms of the permits) be forthcoming
through Mr. McRight? Unfortunately, it seems there has been a bottleneck in the flow of that paperwork at some point
in Raleigh. I haven't seen any memos return regarding NC0036561 United Church Retirement Home, NC0059536 Hilltop
Living Center or NC0070637 Kurz Transfer Products (but I did appreciate your note on this one), all of which left our
office on April 8. Curiously, I did receive your signed return on NC0051713 Lakeview MHP, that was sent out the same

On behalf of our BOD'S & Ammonia which limits are 5 & 2 on our permits, we
are finding it harder to meet our limits. Due to more clients have been added onto the
facility, more water is being used. Currently we have 65 residents, which is more than
what we usually have. Our capacity is for 96 residents. If you could up the limits so we
can be in compliance, we would gladly appreciate it.
