Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on December 3, 2008. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. (3) ACUTE TOXICITY Limit (Quarterly) The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of February, May, August and November. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Additionally, DWQ Form AT-2 (original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year oldie report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Receiving stream or affected surface waters: Long Branch (both outfalls) a. Classification: C b. River Basin and Subbasin No.: Yadkin 03-07-13 c. Describe receiving stream features and pertinent downstream uses: Long Branch at outfall 001 is a heavily braided channel, which passes through an area that was at one time a small pond. As a result of long-term siltation from past site activities, this former pond completely filled in with sediment and is now heavily vegetated by wetland plants and trees. Any discharges from outfall 001 would have to pass through this vegetation and then through a 2.58 acre man-made impoundment before exiting underground and eventually returning to normal stream conditions. The discharge at outfall 002 (Long Branch) is actually into the man-made impoundment noted above, which is located immediately below outfall 001. There is no discernable outlet from this structure, however, past DWQ investigations were able to determine that water in this impoundment exited underground and reappeared immediately below the impoundment as a flowing stream. In previous correspondence from the Division, the former owner of this site (Carolina Solite) was notified that this channel was considered "Waters of the State" and could not be used for treatment. There are no known users downstream of either discharge. PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS 1. a. Volume of wastewater to be permitted: No limit in the current permit (intermittent discharge) b. What is the current permitted capacity of the wastewater treatment facility? No limit (intermittent discharge) c. Actual treatment capacity of the current facility (current design capacity)? There are no WWT facilities. d. Date(s) and construction activities allowed by previous Authorizations to Construct issued in the previous two years: There have been no ATCs issued in the past two years nor are any being considered at this time. e. Please provide a description of existing or substantially constructed wastewater treatment facilities: Existing WWT facilities at outfall 001 consist of a 0.2 acre earthen settling basin concrete settling cells (the discharge from this outfall is only allowed during a 5-year storm event or greater). The effluent from the concrete settling cells discharges to the quarry pit and then eventually out through outfall 002. Page Three f. Please provide a description of proposed wastewater treatment facilities: There are no proposed WWT facilities at this time. 2. Special monitoring or limitations (including toxicity) requests: The current permit list the upstream monitoring location for both outfall 001 and 002 as: "200 feet from the outfall". During the site visit on 9/11/2008, it was determined that this location is not appropriate given the current site constraints and a new location was located and agreed upon by both DWQ and Hedrick personnel. This new location is on Long Branch at a point upstream where the railroad track crosses the channel. This location should satisfy the upstream monitoring requirements for both outfalls. 3. Important SOC, JOC or Compliance Schedule dates: This facility is neither under an SOC nor is one being considered at this time. PART IV - EVALUATION AND RECOMMENDATIONS BV Hedrick has applied for renewal of the subject permit. There have been some changes to the current operation since the permit was last renewed (see Part II, No. 1(e) above) including the addition of a second outfall. There are no significant changes proposed at this renewal with the exception of the changes noted in Part III, No. 2 above. The water is then pumped from this location to the existing concrete cells which can handle over 1 million gallons of water. We use a flocculent (O'B FLOC AE-612) to treat the water in the concrete cells. The water is then pumped from the cells to the pit. From there the water is pumped from the pit to the waters of the state formerly known as the Treatment Works Pond (outfall 002). I have also added outfall 001 from the dike area in case of a possible discharge during a 5 year storm event.
