Dear Mr. Lastinger and Ms. Higgins,
On behalf of Standard Pacific Homes - Raleigh, we are requesting authorization from the USACE to
use NWP 3 for 0.046 acres of permanent wetland impacts, 20 if of permanent stream impacts and
0.037 acres of open water impacts for construction activities associated with the rehabilitation of
the exiting Lake Castleberry dam. Please note that this application is being provided to NCDWR as a
courtesy, as the proposed project does not require written authorization from NCDWR.
The proposed project is located on a ±26 acre parcel (PIN 0713822568), located north of the
intersection of Castleberry Road and Sleepy Valley Road in Apex (Latitude: 35.7621 °N; Longitude: -
78.9404 °W). The project is located in both Wake and Chatham Counties, as the county line runs
through the dam. Castleberry Lake is located in the Cape Fear River basin and drains to White Oak
Creek. The Water Quality Classification for White Oak Creek is WS- V;NSW;CA and the Stream Index
Number is: 16- 41- 6- (3.5). The cataloging unit for the site is 03030002.
Proposed Proiect
The purpose of the proposed project is to rehabilitate the existing Lake Castleberry dam. The dam is
currently structurally unsound and needs to be repaired to prevent a catastrophic failure. Previous
overtopping of the dam has caused significant erosion of the downstream face, as well as caused
numerous large trees growing on the dam to fall, which has compromised the structural integrity of
the dam. Also, wave action has caused significant erosion to the upstream dam face. Currently, the
outfall pipe is clogged, and the primary spillway on the southern end of the dam is acting as the
primary outlet. The emergency spillway on the northern end of the dam is not functioning at all, as
evidenced by the over topping of the dam during significant storm events.
In order to improve the dam to meet Dam Safety requirements, the dam must be increased in height
by two feet to prevent over topping, and widened to increase strength and stability. The dam will be
widened by buttressing the new section of dam to the existing dam to increase strength and
stability. The dam will be widened an average of 30 if beyond the existing footprint of the dam on
the downstream side, with the greatest expansion being approximately 50 If. Also, the outfalls must
be upgraded. This will be accomplished by replacing the existing 18" RCP which is currently clogged
to handle base flow and normal pool. The primary spillway currently consists of rip -rap, and will be
upgraded to a concrete drop spillway to handle outfall during normal storm events. The proposed
drop spillway will be constructed in the location of existing retaining walls and rip -rap which was

previously impacted, and does not constitute a stream impact. There will be rip -rap placed within
the stream below the drop spillway outside of the footprint of the previous rip -rap, which has been
assessed as a permanent stream impact (Stream Impact #1). The emergency spillway will be
cleaned out and reestablished in order to handle outfatt during the loo year storm event, which will
prevent over topping of the dam during extreme storm events.
The expansion /widening of the dam will occur on the downstream side of the dam, and there will be
no expansion of the footprint of the dam within the lake. Also, the existing normal pool elevation of
the lake ( ±268') will be maintained, and the proposed dam rehab will not affect the normal water
level of the lake upon completion of construction.
In order to prevent future erosion from wave action, there will be shoreline stabilization measures
installed along the upstream face of the dam. The proposed shoreline stabilization will consist of
geo -grid, which is a ±6" deep honeycomb -like structure, which will be put in place and backfitted
with soil and seeded so that grass will grow overthe geo -grid. The shoreline stabilization will be
installed approximately 2 if above and 2 if below the normal pool of the lake. The majority of the
proposed shoreline stabilization will be located on top of the existing fill slope of the dam. The
shoreline stabilization at the emergency spillway at the northern end of the dam will extend past the
existing footprint of the dam into the lake, which has been assessed as an impact to open waters
(Open Water Impact #1).
In order to safely complete the proposed construction, the water level within the lake will be
dropped by 8'. Foster Lake & Pond Management completed a bathymetric survey of the lake and
determined that there would still be plenty of water for fish to survive with the lake level being
lowered by 8', assuming that an aeration system is installed adn operated throughout the duration
of the project in order to keep oxygen levels high.
Project History
The delineation of the jurisdictional wetlands and streams within the proposed dam rehabilitation
project area were approved as part of the Corps' Jurisdictional Determination for the Johnson
Assemblage property (SAW -2013- 01277) issued 9/18/13, which has been provided as an Appendix.
Proposed Impacts
The proposed impacts consist of 0.046 acres of permanent wetland impacts, 20 if of permanent
stream impacts and 0.037 acres of open water impacts.
The proposed 0.046 acres of permanent wetland impacts will occur from the widening of the
downstream face of the dam to increase the strength and stability of the dam. Widening of the dam
will be accomplished by buttressing the new section of dam to the downstream face of the dam. The
dam will not be widened into Lake Castleberry.
The proposed 20 if of permanent stream impacts will occur from the placement of rip -rap below the
proposed drop- spillway in order to dissipate flow and prevent erosion. Please note that the
proposed drop- spillway will be constructed within the existing footprint of the existing retaining
walls and rip -rap, and therefore have not been assessed as new impacts.

The proposed 0.037 acres of open water impacts will occur from installation of the geo -grid as
shoreline stabilization to prevent future erosion from wave action. Open water impacts have been
assessed for areas where the geo -grid will be installed beyond the existing fill slope of the dam.
Open water impacts were not assessed for geo -grid placed within the existing fill slope of the dam.
Avoidance and Minimization
The proposed dam rehabilitation has been designed to minimize impacts to the greatest extent
possible while ultimately meeting dam safety standards.
During construction, the water level within the lake will be dropped by 8'. An aeration system will be
installed and operated for the duration of construction to ensure that oxygen levels within the lake
remain high to support aquatic life.
Mitigation
Since the proposed impacts are part of the maintenance of the existing dam, and impacts are
minimal, no mitigation is proposed.
The current request is for 0.046 acres of permanent wetland impacts, 20 if of permanent stream
impacts and 0.037 acres of open water impacts (see the attached maps and PCN for details).

The site currently consists of Lake Castleberry and undeveloped woodlands. The general land use in the vicinity consists
of residential development.

There are ±0.046 acres of wetlands within the project area. The project area consists of the area within the proposed
dam rehabilitation footprint. See enclosed plans for details.
