Landon Davidson, PG to Mr. Accetturo (Applicant) and Mr. Vilas (Consultant). Each item raised in Mr. Davidson's letter will be addressed sequentially below: 1. Avoidance and Minimization of Wetland Impacts: It is important to emphasize that the current project is a continuation of a project initiated by other in the early to mid- 2000's. The original developer had installed the roads, utilities, plated the single family residential lots, obtained approval for and constructed two condominium buildings (two units each), and performed preliminary grading for the cottage area. It is within this cottage area that all of the wetland impacts referenced are proposed to occur. The proposed project is in keeping with the original plan initiated by the previous developer and the current Applicant purchased the project with the reasonable expectation of completing the project as it was originally intended. The area of the proposed wetland impacts is well suited for and was planned as a clustered cottage area. The previous developer did a substantial amount of grading in these areas leaving some distinct low areas, which contain the delineated wetlands. As stated in the original PCN, it is not clear if these areas were wetlands before the area was graded by the previous developer. Analysis of old aerial photographs appears to show the area was a Christmas tree farm. The proposed plan requires that the low areas be filled in order to create a reasonably level area upon which to build roads, parking, sidewalks and cottage units. In the vicinity of wetland units #1 and #4, the site is to be filled between 4 and 6 feet and impacts could not be avoided. Wetland unit 3 will be preserved intact and approximately 2/3 of wetland unit #3 will be preserved. One cottage unit and associated parking was eliminated to reduce impacts to wetland unit #3. 2. Stormwater Management BMP Issues: Revised Stormwater Management Plans are attached along with calculations: a. Design Change: The sand filter BMP has now been replaced with a wet detention basin. A combination of factors led to this change including cost, high water table, ability to treat all the stormwater with one measure, ability to satisfy both local stormwater quantity requirements and state stormwater quality requirements with one measure, and cost. b. The Town of Banner Elk Zoning Ordinance requires pre -post management of the 10- yr 24 hour storm, the engineer has determined that this detention volume is contained in the temporary storage of the proposed wet detention pond and no additional storage is needed above that needed to meet state water quality standards. c. Basin O &M form submitted previously d. See Wet Detention Supplement Form attached. e. Forebays are now included for both basin inflow locations. • page 2 February 10, 2014 f.
