Director NORTH CAROLINA Environmental Quality June 30, 2022 Barrett Jenkins DWR Project #: 2017-0110v2 Restoration Systems, LLC Wayne County 1101 Haynes St., Suite 211 Raleigh, NC 27607 (via electronic mail: bienkins&restorationsystems.com ) Re: Weaver Farm Mitigation Banking Instrument (MBI) Weaver Farm Nutrient Offset & Buffer Mitigation Bank Credit Release— Task 8 Dear Mr. Jenkins: On November 16, 2021, the Division of Water Resources (DWR) received a Year 4 Monitoring Report from Restoration Systems, LLC (RS) for the Weaver Farm Mitigation Site. Data provided in the report suggests that the significant replanting and seeding efforts, soil amendments, and chemical treatments performed on the site as part of the Adaptive Management Plan are benefitting the site. According to the monitoring report, the following items were noted: 1. 4 of 22 plots failed to meet performance criteria; Two of these plots only failed by 1 stem. However, plots 18 & 22 only had 2 planted stems present. 2. Stems appear to be doing better this year than in years past, with many stems starting to reach 3-5 feet. Considering the nature of the remedial efforts taken place across this site, tree heights are relatively normal. 3. Photos provided in the report show healthy herbaceous vegetation throughout all the plots. Based on the current conditions of the site revealed in the monitoring data, the history of this site, the remediation performed, the health of planted stems and the presence (or lack thereof) of acceptable volunteer species, it is highly likely that an additional monitoring year may be required, which would extend into Fall 2023. This decision will be made when the submittal of the Year 5 monitoring report is reviewed by DWR staff in Winter 2022 and a site visit performed. Additionally, in alignment with the previous credit releases, RS is to continue to maintain herbaceous cover throughout the site where evidence of bare soil and lack of herbaceous cover is present. RS is to add at least 3 stratified random tansects and provide corresponding vegetation data with each annual report through Year 5. Transects can be in any shape but must be comparable in size with the fixed vegetation plots. Transects must include a GPS coordinate and bearings so they can be identified in the field when needed. Transect data are to include planted and volunteer stems that measure at least 12 inches in height, photos and a supporting figure showing their physical location. Lastly, RS is to ensure flagging is maintained on all planted stems within each monitoring plot. The term of this bond applies through the approval by DWR of the Year 5 Monitoring Report and therefore, may be required to be renewed upon notification of that approval if an additional monitoring year is deemed necessary. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. In accordance with the MBI, signed on July 7, 2017, the following Project Milestones have been met, and the corresponding credits shall be released: Task/Milestones Credit 8) Monitoring Report #4: Approved by the DWR & financial 5% assurance renewed (full release) By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and 5% of your Neuse riparian buffer Restoration credits (0.05 x 267,894 ft2 = 13,394.70 ft2) and 5% of your Nitrogen nutrient offset credits (0.05 x 34,913.58 lb-N = 1,745.68 lb-N) are now available for sale. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC 02B .0703. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin according to guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015. Additionally, riparian buffer Preservation credits cannot be converted into nutrient offset credits.
