Skvaria, III Secretary DWR # 14 -0475 Moore County On May 12, 2014, the Division of Water Resources (Division) received your application dated April 15, 2014, requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. When the applicant is a corporation, the Division requires the state in which it its domesticated, the name of its principal officers, the name and address of the NC process agency and the name of the individual who shall be primarily responsible (pursuant to 15A NCAC 02H .0502 (a)(3)). BCMB INC is not listed on the NC Department of the Secretary of State's Corporation website (httP://www.secretary.state.nc.us/Corporations/CSearch.aspx), however BCMB, LLC is listed (see attached document). if the applicant is BCMB, LLC, please correct the applicant information on the PCN. If the applicant is BCMB INC, they will need to register with the Secretary of State before the Division can process an application from BCMB INC. 2. According to the parcel information provided in the application, the current owner of the parcel is not BCMB INC or BCMB, LLC. Skvarla, III Secretary Expiration of Acceptance: November 19, 2014 County: Moore The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state federal or local Rovernment permits, regulations or authorizations associated with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by S.L. 2011 -343. This acceptance is valid for six months from the date of this letter and is not transferable. Grass height will not exceed six inches at any time; and grass will not be mowed too close to the ground or "scalped ". 2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build -up, erosion, and trash accumulation. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded following sediment removal. 4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope. 5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts, velocity reduction devices and piping. 6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Energy, Mineral and Land Resources.
