Director Division of Water Quality October 23, 2006 DWQ# 06-1561 Guilford County Reference: Section 401 Water Quality Certification for the Life Community Church of Hunter Hills Mr. Robert Emanuel Life Community Church of Hunter Hills 4900 West Wendover Avenue Jamestown, NC 27282 Dear Mr. Emanuel: On September 27, 2006, the North Carolina Division of Water Quality (DWQ) received your application for a 401 General Water Quality Certification to impact 140 linear feet of an unnamed tributary to Long Branch in order to provide fill for future expansion of church facilities located at 4900 West Wendover Avenue in Jamestown, Guilford County. On October 10, 2006, Mr. Daryl Lamb of the DWQ's Winston-Salem Regional Office conducted an onsite review of the proposed fill. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. Please provide five (S) copies of the following information: 1. You have not demonstrated an adequate effort to avoid and minimize impacts to the onsite perennial stream by considering alternatives to piping and placement of fill. Based on Mr. Lamb's site visit on October 10, 2006, there appear to be other areas of church property suitable for expansion, which would not require the placement of fill in this stream. In addition it does not appear that the stream in question will pose a major impediment to the extension of the existing access road to Wendover Avenue. Please provide a thorough and detailed explanation of why you believe this fill is necessary in order to provide for future facilities expansion and access road extension. Please provide a description of your efforts to avoid and/or minimize this impact by considering alternatives, such as utilization of other areas of church property. 2. In Section XI. (Stormwater) on Page 12 of the application, you indicate that no additional impervious surface will result from the piping of the stream and placement of fill over the pipe. However, in Section III. (Project Information), Item 11. on Page 7, you state that the purpose of this fill is to allow for expansion of church facilities. You have provided no specific expansion plans or details. The Division of Water Quality must therefore assume that the fill area will ultimately consist of 100% impervious surface. If the current stormwater management facilities cannot provide adequate treatment of the increased stormwater flow, you must provide details of the additional engineered stormwater controls that you will provide on your sate to adequately treat all stormwater generated by your expanded facility. 3. In Section X. (Proposed Impacts on Riparian and Watershed Buffers) on Page 11 of the application, you indicate that the proposed fill will result in impacts to both Zone 1 (8,519 ft2 of impact) and Zone 2 (7,273 ftZ of impact) of the Randleman Lake Water Supply Watershed buffer that exists along the onsite stream. Based upon the project description, the Division of Water Quality believes that a Major Variance to the Randleman Lake Water Supply Watershed Buffer Rules (15A NCAC 02B. 0250) will be required for this project. Please contact Ms. Amy Chapman, coordinator of the Buffer Rules in the 401 Oversight/Express Review Permitting Unit, at (919) 715-6823 to discuss the application process for obtaining a Major Variance. Until the information requested in this letter is provided, I will request (by copy of this letter) that the U.S. Army Corps of Engineers place this project on hold. Also, this project will be placed on hold for DWQ processing due to incomplete information (15A NCAC 2H .0507(h)). The processing of this application will begin when the requested information is received. Please be advised that if your proposed activity is subject to Section 404 of the Clean Water Act (33 U.S.C. 1344), you must also receive a Section 401 Water Quality Certification from the N. C. Division of Water Quality before you begin any work. Please send the requested information to Mr. Ian McMillan, N. C.
