PROJECT SUMMARY: The project is for a pier, uncovered and covered platform and covered boatlift for 167 Big Hammock Point Road. As a requirement of the original major permit for the Pelican Point s/d this lot had a deed restriction which prohibited a dock to be built on Chadwick Bay; since then, the deed restriction has been removed. Narrative Description: The 167 Big Hammock Point Road project is located at Big Hammock Point Road which is part of the existing Pelican Point subdivision. Pelican Point was permitted through major permit # 43-95 for infrastructure, 48 lots, and a community docking facility. Big Hammock Point Rd. is found by turning left off of Grandview Drive in Sneads Ferry. Chadwick Bay borders this site to the west. Permit #43-95 was originally issued to Pelican Point S/D by Scarafoni Associates, Inc., on April 24,1995. The original permit had deed restrictions which read, "deed restrictions shall be placed on the owners of all unsold lots on Chadwick Bay specifically lots 8, 9, 13, 14, 15, 16, and 17 that prohibits them from construction out into Chadwick Bay. The owner of lot 46 shall also have deed restrictions prohibiting construction waterward of MHW since it will be entitled to a boat slip within the community pier and dock." 167 Big Hammock Point Rd. is identified as lot 17 according to permit #43-95, restrictive covenants recorded in book 1145, Page 445, Onslow County Registry. After the permit authorization of # 43-95, the original applicant, Scarafoni Associates, Inc. transferred ownership to the Pelican Point Homeowners Association. On 5/4/2021 Mr. Wiest received a "RELEASE FROM DECLARATION OF PROTECTIVE COVENANTS OF PELICAN POINT," recorded in book 5452, Pages 559-563, Onslow County Registry. 167 Big Hammock Point Rd. is .798 acres (34,793 Sq.ft) in its entirety and is an average of 13' above NHW. The total length of the shoreline is 117'. There is a 75' x 105' fringe of Coastal Wetlands present along the shore adjacent to Chadwick Bay. This fringe contains Smooth Coordgrass (Spartina alterniflora), Giant Cordgrass (Spartina cynosuriodes), Black Needlerush (Juncus romerianus), and Salt Meadow Grass (Spartina patens). Within the waters of Chadwick Bay expanses of franchised oyster beds are present. The water depths in Chadwick Bay are shallow (-2'nlw) and according to the applicant and DMF site visit records, reach —3' NLW within the channel portion and an average of — 2' at NLW at the waterward end of the proposed structure. There is an unnamed "slough" along the waterward edge of the property. The slough varies in width along the property from 12' to 22' wide and has an average depth of 9" at normal high water and would be classified as "navigable" by the Division. This section of Chadwick Bay is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is Conditionally Approved - Open to the taking of shellfish. Onslow County Land Use Plan dated 2010 classifies this area as Conservation within the AECs. Field Investigation Report: Wiest 167 Big Hammock Point Road Page 03 10. Proiect Description: The applicant is proposing a 5' x 286' pier, a partially covered 18' x 19' platform part of which is a 13' x 13' covered area with a 1' overhang on the eastern and southern side, a 16' x 26' covered boatlift. The covered boatlift will be surrounded by two finger piers 19' x 3' and 24" x 3' and will contain a 13' x 13' boatlift. No upland development is proposed. The pier would extend from high ground and cross over coastal wetlands landward of NHW for approximately 181'. Cross a 14' area of navigable waters and be elevated 6' above the normal high water (NHW) level, continue over another 25' section of coastal wetlands, and extend 38' over open water to lead to the docking facility. The maximum boat length would be 21' and of open runabout design. The water depths along the platform and within the slip is -1.92 to -2.0' at normal low water as verified by Kim Harding with the Division of Marine Fisheries. The most water ward portion of the structure would be located 67' waterward of the edge of the marsh. The Division has determined through previous permit activity, that the configuration of marsh and oyster beds along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 1,460' . In consideration of this, the impedance into the water body by the structure consequently extends approximately 67' into the 1,460' waterbody of Chadwick Bay. The pier and platform would be located approximately 29' to the west and 34' to the east of the adjacent riparian lines. 11. Anticipated Impacts: The proposed pier as would shade and incorporate 175 ft? of coastal wetlands above NHW, as well as shade and incorporate750 ft2 of coastal wetlands below NHW. A total 2,082 ft2 of open water of would be shaded and 1,198 ft2 incorporated by the pier, platform and boatlift. The structure should not cause a hindrance to navigation. The docking facility will be located within the shellfish lease/franchise area of Brian Shephard.
