Good afternoon Jeremiah,
The 15-Day As-Built/MYO review for the Dynamite Creek Mitigation Site (SAW-2019-00909) ended June 15, 2022. This review was done in
accordance with Section 332.8(o)(9) of the 2008 Mitigation Rule. All comments received from the NCIRT are incorporated in the email below. Please
address IRT concerns in the MY1 Report and reply to this email with satisfactory justification for the E1 reach ratio due to the construction changes
and, thereby, less functional uplift. There were no objections to issuing the initial (30% ) credit release of 1,080.510 warm SM Us and 2.756 riparian
WM Us. Please find attached the current signed ledger. The IRT is not requesting a site visit at this time.
USEPA Comments, Todd Bowers:
* Minimal adjustments were made during construction, where needed, based on field evaluations. All deviations noted in the report are
minor (structure locations, minor GPS errors and suitable replacements/adjustments due to lack of brush).
* No stream areas of concern were identified at this time. Cross -sections show streams are stable and functioning as designed. ERs are over
2.2 and BHRs are below 1.2.
* There are no vegetation areas of concern. Average stem density across the site is 595 planted stems per acre and all 13 vegetation plots
are meeting interim success criteria.
* Crest gauge installed on Dynamite Creek Reach 6 for MY1 hydrology data collection.
* Ten groundwater gauges and one soil temperature probe were installed across wetland areas for MY1 groundwater monitoring and data
collection.
* No adaptive management plan needed at this time.
* No issues of conservation easement encroachment.
Overall, I am very satisfied with the report and the work that has been completed at the site. Having not been on -site, I really appreciated the
detailed ground -level stream and veg plot photos. I recommend the appropriate credit release (Milestone 2) for warm stream and riparian wetland
mitigation units for this monitoring milestone. I have no other substantial comments at this time.
USACE Comments, Casey Haywood:
1. Dynamite Creek Reach 5- It was noted that the proposed riffles and log sills were not installed due to the channel not being realigned and
to save existing trees. What is the condition of the bed material in this reach? The mitigation plan indicated the reach was proposed for El based on
the level of intervention and potential for ecological uplift. What was the overall percentage of the reach that was worked on to provide functional
uplift to justify the ratio?
2. Why were some of the structures not able to be located (valley sills, log sills, brush toe and cover log)?
3. The drone footage was appreciated and helpful for the review. Overall, the Site looks good and appears to be functioning as designed.
NCDWR Comments, Erin Davis:
1. DWR supports/reiterates USACE's questions and comments.
2. How were the added cover logs anchored with the brush toe? Were footer logs used?
3. Please confirm that vernal pools excavated greater than 1 foot do not overlap wetland credit area.
4. Invasives were noted to be "much removed" during construction. Please target remaining invasives during MY1.

The below referenced FINAL Record Drawing (As -Built) Report review has been requested by NCDMS. Per Section 332.8(o)(9) of the 2008
Mitigation Rule, this review follows the streamlined review process, which requires an IRT review period of 15 calendar days from this email
notification. Please provide any comments by 5 PM on the 15-day comment deadline shown below. When providing comments please indicate if
your concerns are great enough that you recommend not issuing the credit release. Comments provided after the 15-day comment deadline
(shown below) may not be considered.
At the conclusion of this comment period, a copy of all comments will be provided to NCDMS and the NCIRT along with District Engineer's intent to
approve or disapprove this Final Record Drawing and initial credit release.

1 - For NCDMS, no credits are released during the first milestone (Site Establishment).
2 - For NCDMS projects, the initial credit release milestone occurs when the as -built report (baseline monitoring report) has been approved by the NCIRT and
posted to the NCDMS Portal, provided the following criteria are met:
1) Approval of Final Mitigation Plan;
2) Recordation of the preservation mechanism, as well as a title opinion acceptable to the USACE covering the property;
3) Completion of all physical and biological improvements to the mitigation site pursuant to the mitigation plan;
4) Receipt of necessary DA permit authorization or written DA approval for projects where DA permit issuance is not required.
3 - A 10% reserve of credits is to be held back until the bankful event performance standard has been met.
