Dunn, Coastal Coordinator Habitat Conservation Division DATE: June 22, 2022 SUBJECT: CAMA Dredge/Fill Permit Application for Thomas Perrone, Brunswick County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 2632 Mariners Way SE, adjacent the AIWW in St. James / Southport, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson - Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to construct a new private three slip docking facility. A 134' by 6' pier would extend from the property and terminate in a fixed 20' by 20' L-shaped gazebo. Immediately west of the gazebo would be a 13' by 13' lift in -1.2' to -1.5' NLW, East of the gazebo is a 16' by 8' ramp to a floating dock parallel to shore for slips 2 and 3 in water depths - 1.5' to -1.7' NLW. The AIWW in this location is classified SA by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). To reduce the likelihood of docks sitting on substrate, stops should be incorporated. In addition to the concern with the floating docks, we have a concern with water depths. The NCWRC does not generally support slips in water depths less than -1.5' within PNAs especially if lifts are not incorporated. Slip three on the landward side of the floating dock appears to be in water depths less than -1.5'. The NCWRC would support any comments presented by the NCDMF, including design alterations or moratoria, to minimize impacts to NCDMF PNA resources.
