The Division of Water Quality's (Division) Raleigh Regional Office has conducted a
review of the subject permit application.package. During review of the land application fields,
an issue with the crop planted in field HA14-1, owned by Keith Parrish, was discovered.
Field HA14-1, located in Harnett County, was planted in tobacco on the day of the site
visit. According to the annual report submitted on February 17, 2006, residuals were applied to
this field in November and December of 2005. 40 CFR 503.32 (1)(5)(i) states that "Food crops
with harvested parts that touch the sewage sludge/soil mixture and are totally above the land
surface shall not be harvested for.14 months after the application of sewage sludge." Tobacco is
-defined as a food crop by 40'CFR 503:9(1)-.-This is also discussed:iri, Condition 120 of -Permit -

Please be advised that if the tobacco is harvested before February 2007, that the Town
of Fuquay-Varina may be in violation of Permit WQ0020016 and 40' CFR 503.
Required Additional Information:
Please notify Mr. Parrish of the prohibition ofharvesting the tobacco immediately.
Please notify this office of the outcome of that conversation as soon as possible, but no later than
one week from receipt of this letter.
