Dead Tree A Bank Parcel Credit Release — Tasks I & 2
Dear Mr. Jenkins:
On November 16, 2021, the Division of Water Resources (DWR) approved a Bank Parcel
Development Package (BPDP) for the above -referenced site under the terms and conditions of the
Restoration Systems, LLC (RS) Dead Tree Nutrient Offset Umbrella Banking Instrument (NOBI) to
establish a nutrient offset bank. On June 7, 2022, DWR received a recorded conservation easement
and corresponding plat for the subject site.
Additionally, on June 7, 2022, DWR received documentation from RS that the Dead Tree A site had
been planted and constructed in its entirety and monitoring plots had been installed. On June 21,
2022, staff with DWR along with assistance from staff with RS, inspected the site and confirmed that
the subject site had been fully planted, mostly seeded, all monitoring plots had been installed, and
conservation easement posts identifying the conservation easement boundary were installed. DWR
staff observed bare areas around the site where seeding had not been well established. RS needs to
monitor all bare areas to ensure vegetation becomes established. It was also observed that
notification placards for the easement posts had not been installed. Therefore, RS will have to
submit photo documentation with the As -Built Report confirming placards have been added to the
posts prior to receiving a credit release for Task 3.
In accordance with the NOBI, signed on November 10, 2021, the following Project Milestones have
been met and the corresponding credits shall be released:

& Financial Assurance Posted (not needed for this site)
2) All Riparian Earthwork, Planting and Installation of Monitoring Devices 20%
Completed, easement boundaries adequately marked, and applicable permits

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and the following credits are released to sell:
• 40% of the Nitrogen nutrient offset credits (0.40 x 136,543.476 lb-N = 54,617.390 lb-N)
• 40% of the Phosphorus nutrient offset credits (0.40 x 8,794.455 lb-P = 3,517.782 lb-P)
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020101 of the Tar -Pamlico River Basin pursuant to 15A NCAC 02B .0703, which became
effective on April 1, 2020.
Please use the Credit Ledger Templates provided in the approved NOBI to track and report credit
availability for the Dead Tree A Nutrient Offset Bank. Upon receiving this correspondence, please
submit three (2) credit ledgers to DWR reflecting the available credits released for each mitigation
type (Nitrogen Nutrient Offset, Phosphorus Nutrient Offset).
