Dear Mr. Dellinger:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit contains the following changes to its terms from those found in the draft permit sent to
you on February 12, 2014:
• A footnote stating limits and monitoring requirements for Total Residual Chlorine applied only if
chlorine was added for disinfection was erroneously removed within the draft. The footnote has
been replaced in the final permit document.
• Section A. (2.), regarding outfall 002 has been removed from the permit. It has been confirmed that
the facility's boiler blowdown wastewater does not discharge to surface waters.
You are reminded of the new condition requiring electronic reporting of discharge monitoring report
(DMR) data using the Division's eDMR internet application. This new requirement will become
effective on March 1, 2015.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the

This permit may be reopened and modified to implement nutrient requirements in accordance with any
future TMDL and/or nutrient management strategy for High Rock Lake.

A. (3.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals, then permittees must
submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates
that these regulations will be adopted and is beginning implementation in late 2013.
NOTE: This special condition supplements or supersedes the following sections within Part II of this
permit (Standard Conditions for NPDES Permits):

1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)1
Beginning no later than 270 days from the effective date of this permit, the permittee shall begin
reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation
(CROMERR), permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the
facility being physically located in an area where less than 10 percent of the households have
broadband access, then a temporary waiver from the NPDES electronic reporting requirements may
be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1,1.1, 2, 3)
or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be
valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part
II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall
make the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF
CERTIFICATION WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qual fed personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is, to the best of my knowledge and belief, true, accurate,
and complete. I am aware that there are significant penalties for submitting false information,
including the possibility of fines and imprisonment for knowing violations."
3. Records Retention [Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years from the
date of the report. This period may be extended by request of the Director at any time [40 CFR
122.41].

I've never been involved in the decision to require fecal monitoring, or not, in this permit. I'd just stick with whatever
the current policy is on that, for consistency's sake. If it needs to be added to the permit, the rationale for the change
should be included, as I'm sure they would be asking if it wasn't.
I personally don't have a problem with discharge 002 being removed. The discharge is directed (with a berm) so that it
cannot make it to the only storm drain in the area. There were pH exceedences in 2007 and 2008, but they have
installed a new boiler since then and have not had any problems controlling the pH since then. I have cc'd Corey on my
response and will let comment if he wants to.

Hi Jenifer,
I know you're out as I type this, but when you have a moment upon your return, can you get back in touch with me
regarding this permit (NC0070637)?
I goofed up on at least two counts as I rushed to get the permit out to notice. I saw that it had chlorine contact as a
treatment unit and assumed it was used. This is one of the few permits out there that has no fecal monitoring because
the receiving stream provides sufficient dilution. At one time, I thought we were going to do away with that notion.
Disinfection just seems like the right thing to do these days ... Anyway, I'll fix that for the footnotes to be included like
in previous permits.
The second thing was that I missed the permittee's request to have outfall 002 (boiler blowdown) removed from the
permit. They seem to state that it discharges on the ground away from any conveyance and nothing gets to surface
waters. What do you think about this? Is there no discharge to surface waters? Are they good doing whatever they're
doing? In your 2012 inspection, you stated you witnessed the discharge, but didn't mention that it didn't need to be
permitted. Mr. Dellinger believes you know all about this and can help me do the right thing in the permit.

full Fact Sheets. Expedited permits are generally simple 100% domestics (e.g., schools, mobile
home parks, etc) that can be administratively renewed with minor changes, but can include

An error was made in the drafting of the permit. The footnote was removed that noted TRC
monitoring and limit were only effective if chlorine was added for disinfection. The permit writer
noted a chlorine contact chamber in the facility description and assumed chlorine was used. This
is not true. While the facility has the means to introduce chlorine to disinfect, it does no do so
because it is not required to do so. The relatively small discharge goes to a relatively large
stream, and the dilution provided is so great that monitoring and limits for fecal coliform are not
required. With no requirement to kill bacteria, the facility does not disinfect the effluent.
Therefore, the footnote has been reinstituted in the final version of the permit.
Additionally, the boiler blowdown discharge (002) has been removed from the permit, along with
the associated biocide condition. Boiler blowdown wastewater is still produced, but its flow is
onto the ground, and is directed away from any storm drains on the site. None of the discharge
reaches surface waters. The facility has requested this change for many years. There is concern
about how such an activity may need to be permitted, but it is clear that no surface water
discharge occurs that would require NPDES permit coverage. The responsibility for any other
form of permit coverage is in the hands of the permittee.

Enclosed please find one original and two copies of the NPDES permit renewal
application for Kurz Transfer Products LP. Our facility is located at 4939 North NC Hwy
150 Lexington, NC 27295 (Davidson County). Since our latest permit renewal there are
no changes. I would, however, request that the boiler blow down requirements be
removed from our permit. The boiler blow down is on our property and does not
discharge to Reedy Creek. I have included a statement in the permit application that
describes our sludge management practices. We pump our septic tank annually using a
locally licensed septic pump and hauler.

Domestic flow from 12 toilets to a septic tank. Heavies fall into the tank, liquid flows to
a recirculation/pump tank. (Septic tank Heavies are pumped annually by a licensed
Septic Tank Hauler). The recirculation/pump tank waste water is pumped (10 minutes of
run time every 2 hours) through a sand filter bed and is gravity fed back to the
recirculation/pump tank. The water then enters the discharge tank. As water rises in
the discharge tank it enters the discharge pipe and gravity flows to Reedy Creek.

Briefly describe the manufacturing process(es):
Rolls of polyester are coated in a gravure printing machine with mixtures of waxes, resins and
lacquers. The rolls of polyester are then coated in a vacuum chamber with a thin layer of aluminum.
The finished roll is cut to customer specific lengths and widths and placed on cores. The final product
shipped to our customer is a metaled, colored polyester foil that our customers stamp onto items
such as greeting cards, book covers, cosmetics containers, or other items needing decoration.
There is no contact water in our manufacturing process. We use closed loop steam lines for heating
product. We have a boiler onsite (fueled by natural gas). The boiler is blown down 3 times per week.
The blow down is onto our property. It does not discharge into Reedy Creek. The blow down point is
more than 300 feet from Reedy Creek.
