The Division of Water Resources (Division) received your letter on June 7, 2022, responding to
the compliance inspection evaluation conducted at the Town of Bailey on March 30, 2022, and is
requesting additional information for the following item:
Grease Control Program or Ordinance:
Division Request: The Town did not have a written Grease Control Program or
ordinance. This program is required and shall include [...]
Town's Response: Attached please find the towns grease control program that was made
available to the inspector the day of the inspection. Please see page 7 of the attachment.
This information is also on the town's website.
The Town's response is insufficient. Page 7 of the material submitted by the town does satisfy
the requirement for bi-annual educational materials to be distributed to both commercial and
residential users. However, it does not address any of the other elements required by 15A NCAC
02T.0403. The Town must also develop or show proof of a written Program, Plan, or
Ordinance with the following components at minimum:
- The legal means to require grease interceptors for new construction and retrofit grease
interceptors at existing establishments
- The legal means for inspections of grease interceptors and enforcement for violators
- The legal means to control grease entering the system from other public and private
satellite sewer systems (if applicable).
