Therefore, the development will be designed to comply with the State stormwater requirements. The total contributing site drainage area is 51.69 acres. The project drains to SA waters and is allowed 25% coverage. The contributing impervious areas include 124,804 SF of streets, 16,300 SF for future parking areas, 145,000 SF for 58 townhouse units and 276,830 SF for 94 residential lots as calculated by the computer. There are 58 townhouse units and the allowable built -upon area for each unit is 2,500 SF. There are 94 lots and the allowable built -upon area per lot is 2,945 SF. Stormwater runoff will be collected by a series of swales and will be conveyed by swales to existing drainage systems. This submittal is for a low -density permit. The project sedimentation and erosion control plan was submitted by Sherwin Cribb to allow land clearing and rough grading of the project site only. No imperious surfaces will be created at this time. Our office has been retained by Point Associates, LLC to design the final grading, drainage, stormwater and utilities for the project. We are hoping that the project will meet low density criteria. We expect to submit for a stormwater Management Permit by the end of March or early April, 2000. The North Carolina Administrative Code requires any project that must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply for and receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office. Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal date must be received in this Office no later than March 10, 2000. Failure to respond to this request may result in the initiation of enforcement action, and construction may experience a subsequent delay. The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality Supervisor. Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil erosion control plan prior to the commencement of said land disturbing activity (NCGS 113A-54(d)(4)). The act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted plan within the 30 day periodwill be deemed approval of the plan. Commencement or continuation of a land -disturbing activity under the -jurisdiction. of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. A copy of any erosion and sediment control plan which involves the utilization of ditches for the purpose of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality. We have sent a copy of the subject plans to them, as it appears that dewatering will be involved. It is suggested that you contact Joanne Steenhuis at (910) 395-3900 with the Division of Water Quality if the ditches shown on your plan will lower the water table. The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal and State water quality laws, regulations and rules.
