Unfortunately, we have not received Lit -he permit transfer application for either SW8 980508 or SW8
990851 .
SW8 980508 was inspected on October 12, 2017 and SW8 990851 was last inspected in August
2014. reports attached.
The POA does not need to wait for Mr. Burnette or South Harbor Associates to initiate transfer of the
permit or to sign the transfer application. However, the POA initiates it, the POD will have to accept
the responsibility of addressing any permit compliance issues that we find wher `ale do the
inspection. The Division is rf yore than willing to work with the POA on any compliancy issues by
extending compliance oeadiin s and allovi/ing the POA s :frlcierrt time to assess the lot owners and
save up funds to pay fOr any required compliance work.
V':'e usually lvvait until yvs have the signed transfer application in band before we inspect.
if the POA decides 'hat they want the current permit holder to deal with. any compliance issues, then
plarha- ps it %vould be best if the POPcontacted the permit holder directly to get that started, because -
you wi l need that signature.
There are see trai options For'Lrarisferrinc the permit lasted on the transfer application form. They
cover ail the possibilities, including a transfer firo 1 develclaer to developer (both sign the application),
from developer to HOPROF , (vihere only the developer signs) and from a permittee who is
de,:, -eased, defUnc", or dissolved, to a new otiv per, developer or NON (where only the new owner,
developer or 1-10A signs).

The SHMPOA board voted two months ago to initiate transfer of 8-980508 and 8-990851 to the HOA. Has a permit
transfer been filed and has an compliance report been completed? If yes, can you please forward the compliance report.
If no trandfer form has been filed, pleasr let me know and I'll see what I can do on our end to get things moving.

Now that we started moving the first permit (SW8 980508) to SHMPOA, can I schedule Friday
December 22nd from 9:30-11.00 AM to review the following files listed below at the Wilmington
office? The Master board has asked me to explore any issues we may have in getting the other
South Harbour permits transferred to SHMPOA.
SW8 980508 SHV Associates Marina and South Harbour Village - Transfer in progress. Need
inspection report(s).
SW8 111103 SHV Associates
SW8 970615 Barnes Bluff Associates
- Is this tied in any way to the below permit?
- Is this tied in any way to the above permit?
SW8 990851 Westport and Village Greens - Several NOVs here for BUA IIRC. Need copy of letter
indicating joined lots. so permit BUA can be updated.
Also, I believe that the SW8 990121 stormwater deed restrictions did not actually make it into the
Navigation Point deeds. Perhaps someone from your office could contact Hagood Homes in
Wilmington and get those cleaned up?

Mr. McLendon:
If the HOA would like to accept these permits for the project "as is", then we will gladly accept a
signed transfer application from the HOA, conduct the inspection and transfer the permits. The
Division would work with the HOA to address any compliance issues identified during the inspection.
If the HOA wants the current permit holder to address the compliance issues before the permit is
transferred, then Point Associates will need to initiate that process. Point Associates, LLC is still an
active corporation with the NCSOS, so you should be able to contact their managing member,
Wilmington Holding Corp, Thomas Nuzio, vice-president, to discuss getting the transfer paperwork
signed. The registered agent for Point Associates, LLC is the law firm of Ward and Smith at PO Box
867, New Bern 28563-0867.
The transfer form is attached.

Thank you for pulling the files and allowing me some time to review them. I did notice some
discrepancies for the following permits:
SW8000204 �$len Cove at South Harbour Village and South Harbour Village Golf Villas at Glen Cove
SW89790851 estport and Village Greens Townhouses
Both of these permits are still held in the name of Point Associates,, however ownership was
transferred to the South Harbour Village Master POA by Point Associates on 22 Dec. 2006. I've
attached the deed for your reference_
Can you advise on next steps to transfer the above permits to the SHV Master?

The rules (NCAC 02H.1002(1)) define built -upon area as that portion of a development project that is covered by
impervious or partially impervious surface including but not limited to, buildings, pavement (asphalt, concrete, brick,
stone, slate, coquina) gravel areas, roads, parking lots and paths, and recreation facilities (such as a tennis court).
An impervious surface is one that will not allow water to pass through. A partially impervious surface is one that allows
some water to pass through.
I don't know what kind of written documentation you are referring to. The permittee of record is responsible for
reviewing all the proposed lot plans for compliance with the BUA limits in the permit. Any written documentation as to
whether the lot meets the permitted limits would necessarily come from the permittee after his/her review of the
proposed lot plan.
The Division's job is to ensure that the permittee is doing their job as stipulated by the terms, conditions and limitations
contained in the permit.

I have a few questions regarding the impervious areas in definition of terms for Built -Upon Areas in
permit #SW8-990851; Westport at South Harbour Village. In the Restrictive Covenants for the
property, as found in deed book 1820, page 860, Brunswick County ROD; the covenants states a
definition of Built -Upon Area, classifying pavement, stone, and other built -upon areas. What are the
State requirements in definition of Built -Upon Area? Dies the State allow stone to be defined as
"permeable" or is it defined as "impervious"?
The reason I ask, is that I have a client in the Town of Oak Island that has been referred to the State
permit to meet their impervious area standards. Could you provide some assistance to direct us to
the written documentation needed to meet these requirements?
