Correspondingly, we are forwarding herewith the modifications to the subject permit, which are to be found on the effluent limitations pages. In accordance with your request, the date on which the permitted flow increases from 0.0274 MGD to 0.107 MGD will be changed from March 1, 2001 to January 1, 2001. Please find enclosed the revised permit pages. The revised permit pages should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. (c-- ZL� As indicated in our NPDES Permit, No. NC0086169 and per our request, effluent limitations for the proposed flow of 0.017 MGD become effective on March 1, 2001. Based on current construction progress, we are requesting that the March 1, 2001 date be changed to January 1, 2001. At that time, the permitted flow will increase from 0.0274 MGD to 0.107 MGD and the chronic toxicity concentration will increase from 0.31% to 1.0% per the permit.
