Dear Mr. Miller,
On May 27, 2014, the Division of Water Resources (Division) received applications requesting 401
Water Quality Certifications from the Division for the subject properties. The Division has
determined that the application is incomplete and cannot be processed at this time. The
application is on -hold until the following items are addressed:
1. Please provide documentation from the current owners, SLF II NC Magnolia Bays JV, LLC
and Sisters Cove of LKN, LLC, that gives Ryan Miller of Nest Homes LLC has authority to sign
and apply for a Water Quality Certification for each of the above properties. This can be an
agent authorization or similar form with the appropriate signatures from the owners of the
properties and from Nest Homes, LLC. An example agent authorization form can be found
at: http: / /portal.ncdenr.org/ web /wq /swp /ws/ 401 /certsandpermits /apply /forms.
2. Please send the information requested above within 30 calendar days of your receipt of
this letter to Shelton Sullivan:

This letter only addresses the initial administrative review and does not authorize any impacts to
wetlands, waters or protected buffers. Pursuant to Title 15A NCAC 02H .0502(e), the applicant
shall furnish all of the above requested information for the proper consideration of the
application. If all of the requested information is not received in writing within 30 calendar days of
your receipt of this letter, the Division will be unable to process the application and it will be
returned. The return of this project will necessitate reapplication to the Division for approval,
including a complete application package and the appropriate fee. Please be aware that there is
no authorization under the Section 401 of the Clean Water Act for this activity and any work done
within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
