Note that the water/sewer utility figures have not changed (no utility impacts to wetlands or streams are proposed). Additionally, the most recent survey data and fine tuning of the design have resulted in slight adjustments to the wetland and stream impacts. One new wetland impact has been added. An updated impact table (PCN Form Page 4) is also attached. Amschler (Crystal.C.Amschler@usace.army.mil) <Crystal.C.Amschler@usace.army.mil>; Leslie, Andrea J <andrea.leslie@ncwildlife.org> Subject: Request for Additional Information, Pinner Cove, Buncombe County (DWR Project #202204687) Tyson, On March 22, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please provide a detailed engineering plan, profile view, and cross-section of all proposed culverts. These drawings must include details regarding stream alignment in relation to pipe alignment, pipe slope, pipe burial, and dissipater pad. Culverts must be placed below the elevation of the stream bed by one foot for all culverts with a diameter greater than 48 inches and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches. [15A NCAC 02H .0502(a)(9)] o Please see the revised Figures 5.2-5.5 and 5.7 that now include culvert profiles along with details on culvert material and embedment or use of baffles. 2. All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with the disturbed area. Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. Note the construction details provided on Figure 5.8 appear to be related to utility installation. However, the PCN indicates no utility related impacts are required. [15A NCAC 02H .0506(b)(2) and (3)] o The incorrect detail was used on the submitted detail sheet (Former Figure 5.8). No impacts to wetlands or streams are proposed for utility line crossings. The updated detail sheet (Figure 5.10) now includes the pump -around detail that will be used for stream culvert installation. 3. S2 is proposed to be filled. Please explain how the hydrology in the remaining portion of S2 will be maintained so that the portion of the stream not proposed for impact will continue to support its existing uses. [15A NCAC 02H .0506 (b)(3)] o Figure 5.7 has been updated with a note describing the French Drain system that will be installed in the channel at stream impact S2. Installation of the French Drain will maintain hydrology to downstream waters. 4. When roadways are constructed across wetlands, openings shall be provided to maintain the natural hydrology of the system. There is a dashed line through wetland impact W1. Is that a proposed culvert? If not, how will the natural hydrology of the wetland system be maintained? [15A NCAC 02H .0506(b)] o The dashed line is a culvert that will maintain natural hydrology of the stream and allow surface water connectivity of the wetland on either side of the road. Figure 5.3 has been updated with details on the culvert. 5. It appears that Road A could be shifted slightly to the west and the adjacent stormwater basin elongated to avoid impacts to Wetland W2. Please clarify why the road and stormwater plan for this area cannot be modified to better avoid impacts to wetland W2. [15A NCAC 02H .0506(b)(1)] o Shifting Road A to avoid wetland impact W2 would require the entire intersection, due north of W2, to be shifted to the west to maintain intersection standards. Doing so would not allow for the proposed 2 wet pond to meet the NCDEQ's surface area requirements for the stormwater control measure. Stream buffers to the south of the proposed wet pond also limit reconfiguration options. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by May 4, 2022. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
