Enclosed is a Pre - Construction Notification (PCN) for the proposed storm water treatment pond
to service Hagood Reserve residential development at the intersection of Carmel Road and
Colony Road, in Charlotte, Mecklenburg County, North Carolina. Mr. Len Rindner spoke with
Mr. Steve Kichefski in March 2014 regarding this project and Mr. Kichefski agreed that we
could apply for a Nationwide Permit #29 to use a portion of the existing pond for the new
treatment pond and that no mitigation would be required.

a North Carolina limited liability company (hereinafter "Seller") and COPPER BUILDERS,
INC., a North Carolina corporation (hereinafter "Purchaser").
RECITALS
A. Hagood Reserve, LLC ( "Hagood Reserve', the predecessor in title to Seller, was
the owner of a parcel of real property located at the southeast corner of Colony Road and Carmel
Road in the City of Charlotte, Mecklenburg County, North Carolina, and containing
approximately 9.14 acres, and further described in Deed Book 20179, Page 98, Mecklenburg
County Public Registry (the "Entire Development'. Seller acquired title to Hagood Reserve's
interest in the Entire Development by deed recorded in Book 27435, Page 585, Mecklenburg
County Public Registry, through the foreclosure of a deed of trust recorded in Book 23147, Page
640, Mecklenburg County Public Registry, originally granted by Hagood Reserve to a trustee for
the benefit of First Horizon Home Loans, a Division of First Tennessee Bank National
Association (the "Original Lender'. Seller purchased the loan secured by the deed of mist in
December 2011, and completed the foreclosure pursuant to an Order of the Clerk of Superior
Court of Mecklenburg County, North Carolina, in Special Proceeding Number 10-SP -320 in
June 2012 and recording a Notice of Foreclosure of a Deed of Trust in Deed Book 27578, Page
741, Mecklenburg County Public Registry,
B. Prior to the foreclosure, Hagood Reserve executed and recorded the following
instruments in the Office of the Register of Deeds for Mecklenburg County, North Carolina (the
"Registry'): (1) a subdivision plat of the Entire Development, which is recorded in Plat Book 50
at Page 97 in the Registry (the "Plat"); (2) a Declaration of Condominium for Hagood Reserve
Condominium (the "Condominium"), which is recorded in Book 25813 at Page 185 in the
Registry (the "Declaration"); (3) plats and plans for the Condominium, which are recorded in
Unit Ownership File No. 961 in the Registry (the "Plans"); and (4) a North Carolina Special
Warranty Deed conveying Unit 103 of the Condominium (including an appurtenant 33.52%
undivided interest in the common elements of the Condominium) to Sally H. James and Adele D.
Hagood, Trustees of the W.W. Hagood, Jr. Trust (the " Hagood Trust"), which is recorded in
Book 25814 at Page 689 in the Registry. Although the Original Lender did not subordinate the
lien of its deed of trust to the Declaration or release Unit 103 from the lien and operation of its
deed of trust, the foregoing documents were executed and delivered free and clear of the lien and
operation of the deed of trust pursuant to an order of the United States Bankruptcy Court in the
bankruptcy proceeding involving Hagood Reserve.
C. As a result of the foreclosure and the prior conveyances by Hagood Reserve,
Seller the owner of Units 101 and 102 of the Condominium, and their appurtenant 66.48%
undivided 'interest in the common elements of the Condominium, and the Hagood Trust is the
